QCVN 18:2022/BTTTT on EMC requirements for wireless and ICT equipment, replacing QCVN 18:2014/BTTTT

EXTENDMAX – On November 29, 2022, the Ministry of Information and Communications issued Circular No. 22/2022/TT-BTTTT enclosed with QCVN 18:2022/BTTTT National technical regulation on electromagnetic compatibility for radio communication equipment. The QCVN 18:2022/BTTTT standard was compiled based on ETIS EN 301 489-1 V2.2.2 standard, which includes EMC electromagnetic compatibility requirements for emission and immunity applies to radio-communication equipment in general. Circular No. 22/2022/TT-BTTTT and QCVN 18:2022/BTTTT will take effect from May 1, 2023 and are mandatory for application in import procedures and for certification of conformity and announcement of conformity for certain types of radio transceiver equipment such as SHF, 5G base station, 5G NR phones, walkie-talkies, some types of radars and maritime transceivers from July 1, 2023.

Insights of the QCVN 18:2022/BTTTT

1) Pursuant to Circular 22/2022/TT-BTTTT, the Ministry of Information and Communications encourages organizations and individuals to voluntarily apply QCVN 18:2022/BTTTT from May 1, 2023. However, according to the List of Group 2 goods of the Ministry of Information and Communications, which is Circular No. 02/2022/TT-BTTTT, the mandatory standard is still QCVN 18:2014/BTTTT until July 1, 2023. In case of voluntary application, enterprises still need to test and announce conformity according to QCVN 18:2014/BTTTT.

2) As of July 1, 2023, QCVN 18:2022/BTTTT completely replaces QCVN 18:2014/BTTTT. In case the enterprise continues to import products within the scope of application of this regulation that have been tested and certified for conformity before, the importing company and the manufacturer are not required to re-apply for ICT Type Approval. but will have to re-test according to QCVN 18:2022/BTTTT to make the declaration of conformity according to the new standard.

3) Since the Circular 02/2022/TT-BTTTT on the current list of group 2 goods and the guiding documents No. 2361/BTTTT-KHCN are all refering to QCVN 18:2014/BTTTT, it is expected that the MIC will issue a new Circular on amending, supplementing, or replacing the Circular 02/2022/TT-BTTTT around March or April 2023, listing newly issued technical regulations such as QCVN 130: 2022/BTTTT for wireless audio device, QCVN 131:2022/BTTTT for NB-IoT, QCVN 18:2022/BTTTT, QCVN 132:2022/BTTTT for ITE, MME and takes effect from July 1, 2023.

4) Radio transceivers and information technology affected by this regulation include 5G NR base station and mobile communication terminal equipment such as 5G NR phones, 5G tablets , walkie-talkies, some types of radar and specialized transceivers in the maritime industry from July 1, 2023. Details as the list at the bottom of the article.

5) There are a number of devices within the scope of application of the QCVN 18:2022/BTTTT but not in the current list of Group 2 goods of the Ministry of Information and Communications (Circular 02/2022/TT-BTTTT), for example "Radio equipment for control 27 MHz civil-band single- and/or duplex amplitude mode" and "Transportation 5.8 GHz low-speed data transmission equipment" (formerly these devices were listed on previous list of group 2 goods, which is Circular 01/2021/TT-BTTTT). Is this a warning sign that these products will be returned to the list of products subject to type approval certification and declaration of conformity?

6) There are some products and goods with descriptions to "Listed in Appendix I of this Circular" and "Listed in Appendix II of this Circular", you can understand those contents refer to Appendix I and Appendix II prescribe the list of group 2 goods of the Ministry of Information and Communications (currently it is Circular 02/2022/TT-BTTTT)
