EXTENDMAX – 02/07/2026 – Recently, the Ministry of Science and Technology (MOST) issued a Circular No. 36/2026/TT-BKHCN on the List of Medium-Risk and High-Risk Products and Goods under the management responsibility of MOST for public consultation. Core Changes in the Product and Goods List:
Products and goods (formerly classified as Group 2 products and goods) are now categorized into high-risk and medium-risk groups. Most products listed in Appendix I of Circular 29/2025/TT-BKHCN have been reclassified as high-risk goods. This is not merely a change in terminology, but a fundamental change in import procedures.
Under Decree 37/2026/ND-CP, high-risk products are subject to “pre-market inspection” and must obtain a Certificate of Conformity before customs clearance. In other words, if an enterprise imports high-risk products without obtaining conformity certification, the goods must be taken to a storage location in accordance with Clause 2, Article 83 of Decree No. 37/2026/ND-CP untill conformity certificion process is completed.
Meanwhile, under Decree 74/2018/ND-CP, conformity certification could be completed after customs clearance under the post-market inspection mechanism.

ON ISSUANCE OF THE LISTS OF MEDIUM-RISK AND HIGH-RISK PRODUCTS AND GOODS UNDER STATE MANAGEMENT OF THE MINISTRY OF SCIENCE AND TECHNOLOGY
Pursuant to the Law on Quality of Product and Goods No. 05/2007/QH12, amended by Law No. 78/2025/QH15;
Pursuant to Law on Standards and Technical Regulations No. 68/2006/QH11, amended by Law No. 35/2018/QH14 and Law No. 70/2025/QH15;
Pursuant to the Law on Telecommunications No. 24/2023/QH15;
Pursuant to the Law on Radio Frequency No. 42/2009/QH12, amended by Law No. 09/2022/QH15;
Pursuant to Decree No. 37/2026/ND-CP dated January 23, 2026 of the Government on elaboration and measures to organize and guidance on the implementation of the Law on Quality of Product and Goods;
Pursuant to Decree No. 22/2026/ND-CP dated January 16, 2026 of the Government on elaboration and measures to organize and guidance on the implementation of the Law on Standards and Technical regulations;
Pursuant to Decree No. 55/2025/ND-CP dated March 2, 2025 of the Government on the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;
At the request of the President of the Commission for the Standards, Metrology and Quality of Viet Nam;
The Minister of Science and Technology hereby issues a Circular on issuance of lists of medium-risk and high-risk products and goods under state management of the Ministry of Science and Technology.
Article 1. Scope
This Circular provides for Lists of medium-risk and high-risk products and goods under state management of the Ministry of Science and Technology with their corresponding HS code and quality management requirements.
Article 2. Regulated entities
This Circular applies to:
1. Manufacturers, importers, providers of products and goods under the Lists of medium-risk and high-risk products and goods in the territory of Vietnam.
2. Agencies, units, organizations, and individuals with operations related to management of quality of products and goods under the Lists of medium-risk and high-risk products and goods in the territory of Vietnam.
Article 3. List of high-risk products and goods
The List of high-risk products and goods and their corresponding quality management requirements shall comply with the following regulations:
1. The List of high-risk products and goods is specified in the Appendix I attached hereto.
2. Quality management requirements for high-risk products and goods is specified in the Appendix I attached hereto.
3. For high-risk products and goods, the test with results used as the basis for conformity certification must be carried out by an accredited testing organization or one designated by the Ministry of Science and Technology or recognized in accordance with laws on standards and technical regulations, laws on quality of products and goods, and with a testing scope consistent with the corresponding national technical regulations.
The recognition of test results is carried out in accordance with laws on standards and technical regulations.
Article 4. List of medium-risk products and goods
The List of medium -risk products and goods and their corresponding quality management requirements shall comply with the following regulations:
1. The List of medium -risk products and goods is specified in the Appendix II attached hereto.
2. Quality management requirements for medium-risk products and goods are specified in the Appendix II attached hereto.
3. For medium-risk products and goods, the test with results used as the basis for self-assessment or conformity certification must be carried out by an accredited testing organization or one designated by the Ministry of Science and Technology or recognized in accordance with laws on standards and technical regulations, laws on quality of products and goods, and with a testing scope consistent with the corresponding national technical regulations.
The recognition of test results is carried out in accordance with laws on technical standards and regulations.
Article 5. Rules for management of medium-risk and high-risk products and goods under state management of the Ministry of Science and Technology
1. Quality management of products and goods belonging to the lists of medium-risk and high-risk products and goods shall be carried out in accordance with laws on management of quality of products and goods, technical standards and regulations; regulations of the Ministry of Science and Technology on certification of conformity to regulations, declaration of conformity to regulations, inspection of quality of products and goods and corresponding national technical regulations.
2. Products and goods in the List attached hereto that are subject to two or more national technical standards must fully comply with the corresponding national technical standards; undergo assessment of conformity, certification, and declaration of conformity to regulations according to the risk level and quality management requirements in the List attached hereto, the corresponding national technical standards, and laws on quality of products and goods, and laws on standards and technical regulations; and ensure that there is no duplication of conformity assessment content for the same technical requirement that has already been assessed according to the corresponding national technical standards.
3. In cases where national technical standards issued before the effective date of this Circular provide for different regulations on quality management requirements for products and goods belonging to the lists attached hereto, the regulations of this Circular shall apply.
4. In cases where new national technical standards are issued or the national technical standards specified in the List of medium-risk/high-risk products and goods with are amended or replaced; or where new national technical standards are issued to apply additionally to products and goods on the List attached hereto, the newer documents shall apply from the time they come into force.
5. Medium-risk/high-risk products and goods in the field of atomic energy, including radioactive materials, nuclear equipment, and radiation equipment, are managed according to laws on atomic energy; Clauses 2 and 3 of Article 3 and Clauses 2 and 3 of Article 4 hereof do not apply to products and goods under the scope of management of atomic energy.
Article 6. Effect
1. This Circular comes into force from June 01, 2026.
2. The following documents shall cease to be in effect from the date this Circular comes into force:
a) Circular No. 29/2025/TT-BKHCN dated November 13, 2025, of the Minister of Science and Technology, prescribing Lists of potentially unsafe information technology and telecommunications products and goods under the management of the Ministry of Science and Technology;
b) Circular No. 30/2011/TT-BTTTT dated October 31, 2011, of the Ministry of Information and Communications on issuance of regulations on certification of conformity to regulations and declaration of conformity to regulations for information technology and telecommunications products and goods;
c) Circular No. 15/2018/TT-BTTTT dated November 15, 2018, of the Ministry of Information and Communications amending Circular No. 30/2011/TT-BTTTT;
d) Circular No. 10/2020/TT-BTTTT dated May 7, 2020, of the Ministry of Information and Communications amending Circular No. 30/2011/TT-BTTTT;
đ) Joint Circular No. 58/2015/TTLT-BCT-BKHCN dated December 31, 2015, of the Minister of Industry and Trade and the Minister of Science and Technology, on issuance of regulations on management of quality of domestically manufactured and imported steel;
e) Circular No. 01/2009/TT-BKHCN dated March 20, 2009, of the Minister of Science and Technology, prescribing Lists of potentially unsafe products and goods under the management of the Ministry of Science and Technology.
3. If the legislative documents, national technical standards, or HS codes specified in the Vietnam’s Nomenclature of exports and imports referenced in this Circular are amended or replaced, the newer documents shall apply, unless otherwise prescribed.
Article 7. Transitional provisions
1. The Certificate of conformity to regulations and Notice of acceptance of declaration of conformity to regulations issued before the effective date of this Circular for products and goods within the scope of this Circular shall continue to be valid until the expiration date stated in such Certificate or Notice. The monitoring of the validity of Certificate of conformity to regulations issued before the effective date of this Circular shall continue to be carried out in accordance with applicable regulations at the time such Certificate was issued.
2. Pending applications for certification of conformity to regulations that were received before July 1, 2026 shall continue to be processed according to applicable laws at the time of receipt. Products and goods that have been registered for state inspection of import quality before the effective date of this Circular shall continue to be processed according to applicable laws at the time of receiving the application.
3. Conformity assessment organizations that were previously designated to conduct conformity assessments for Group 2 products and goods under the management of the former Ministry of Science and Technology and the Ministry of Information and Communications (now the Ministry of Science and Technology), and whose designation decision remains valid, may continue to conduct conformity assessments for high-risk and medium-risk products and goods, and the certification methods specified in Appendix I and Appendix II attached hereto, until the expiration of the designation decision.
4. During the period when the National Single-window Portal is being adjusted and upgraded to conform with the List of medium-risk and high-risk products and goods attached hereto, importers of products and goods on the List shall register for state inspection of quality of their imports on the National Public Service Portal or according to the instructions of the inspection authority. The receipt and processing of applications and the delivery of results of state inspections on the quality of imports shall be carried out in accordance with Decree No. 37/2026/ND-CP dated January 23, 2026, of the Government and other relevant laws; ensuring that the legitimate import activities of organizations and individuals are not interrupted.
5. Pending applications for designation of conformity assessment bodies that were received before July 1, 2026 shall continue to be processed according to applicable laws at the time of receipt.
Article 8. Implementation
1. The Chief of Office, the President of the Commission for the Standards, Metrology and Quality of Vietnam, the heads of agencies and units affiliated to the Ministry of Science and Technology, and relevant organizations and individuals are responsible for implementing this Circular.
2. The review and proposal for updating and amending the List of medium-risk/high-risk products and goods under the management of the Ministry of Science and Technology shall be carried out in accordance with Decree No. 37/2026/ND-CP and practical management requirements.
3. The President of the Commission for the Standards, Metrology and Quality of Vietnam shall:
a) Take charge and cooperate with agencies and units affiliated to the Ministry of Science and Technology in reviewing national technical standards corresponding to products and goods in the Lists attached hereto; proposing the issuance of new, amending, and replacing national technical standards according to a suitable roadmap, ensuring quality management requirements corresponding to the risk level of the products and goods;
b) Organize and conduct state inspections of the quality of high-risk imports specified in Appendix I attached hereto for gasoline, diesel fuel, biofuels, and liquefied petroleum gas (LPG) in accordance with laws on quality of products and goods and the assignment and guidance of the Ministry of Science and Technology;
c) Take charge and cooperate with agencies and units affiliated to the Ministry of Science and Technology in developing and submit reports to the Minister of Science and Technology for issuance of regulations and roadmaps for implementing traceability for high-risk products and goods as specified in Appendix I attached hereto.
4. People's Committees of provinces/cities shall:
a) Organize the implementation of this Circular in their provinces/cities according to their assigned functions, tasks, and powers;
b) Direct science and technology agencies and relevant agencies to manage and inspect the quality of products and goods in the Lists attached hereto in accordance with the law. The science and technology agencies affiliated to the provincial People's Committee shall organize state inspections of the quality of high-risk imports specified in Appendix I attached hereto (excluding gasoline, diesel fuel, biofuels, and liquefied petroleum gas (LPG)) in accordance with laws on quality of product and goods and guidance of the Ministry of Science and Technology;
c) Consolidate difficulties and obstacles arising during the implementation process and promptly send them to the Ministry of Science and Technology for review, guidance, or amendment to the Lists to suit practical management.
5. Shall any difficult arise during the implementation of this Circular, promptly report to the Ministry of Science and Technology for review and guidance./.

Note:
- The conformity assessment methods and rules for applying certification methods shall comply with Circular No. 14/2026/TT-BKHCN dated April 9, 2026, of the Minister of Science and Technology, on the declaration of conformity to standards, declaration of conformity to regulations, and methods for assessing the conformity to standards and technical regulations.
- Products and goods with radio-frequency emission functions must comply with Vietnam's radio frequency planning and allocation, the corresponding technical and operating conditions, as well as the applicable laws on radio frequencies.
- Organizations and enterprises manufacturing, importing, distributing, or using such products and goods must commit to properly complying with the laws on the management and use of radio frequencies.
- The implementation of certification of conformity and declaration of conformity to regulations for products and goods listed in Section II of Appendix I and Section II of Appendix II, for certain specific cases. To be specific:
(1) For this technical regulation, products and goods are not required to undergo certification of conformity to regulations but only need to make a declaration of conformity to regulations.
(2) This type of products/goods does not apply to explosion-proof communication equipment.
(3) Short-range radio equipment under this section does not include radio-receive-only equipment; broadband data transmitters operating in the 2,4 GHz band with an equivalent isotropically radiated power (EIRP) of less than 60 mW; radio access equipment in the 5 GHz band with an EIRP of less than 60 mW; broadband data transmitters and standalone radio access equipment operating in the 6 GHz band (5,925 GHz to 6,425 GHz); and Bluetooth and Zigbee equipment with an EIRP of less than 60 mW;
(4) For QCVN 117:2023/BTTTT: the requirements for Total Radiated Sensitivity (TRS) of the receiver under Article 2.2.12, Section B.2.2.18 and Total Radiated Power (TRP) under Article 2.2.13, Section B.2.2.19 of the technical regulation; the technical requirements for GSM technology (2G and 2,5G) shall not apply.
(5) For QCVN 101:2020/BTTTT: only the declaration of conformity to regulations for the safety characteristic requirements specified in Article 2.6 of this technical regulation is mandatory.
(6) For QCVN 65:2021/BTTTT: in Article 2.1.2 of QCVN 65:2021/BTTTT, formula (1) of the technical regulation shall not apply.
(7) For QCVN 128:2021/BTTTT: the Performance requirements for 5G Base Stations under Article 2.4 shall not apply. When applying QCVN 128:2021/BTTTT, equipment supporting the n77 and n78 bands must apply the requirements in Appendix D of QCVN 128:2021/BTTTT, except for the spurious emission limit requirement in Section D.4 of QCVN 128:2021/BTTTT.
(8) For QCVN 131:2022/BTTTT: the requirements for Total Radiated Sensitivity (TRS) of the receiver under Article 2.2.12 and Total Radiated Power (TRP) under Article 2.2.13 shall not apply.
(9) Test/measurement results from domestic or foreign testing laboratories that have not been designated or recognized, or test/measurement results from the manufacturer, may not be used for conformity assessment with respect to this technical regulation.
(10) For QCVN 132:2022/BTTTT: in cases where the product/goods use a voltage adapter, if the adapter is included, testing under QCVN 132:2022/BTTTT shall be conducted on the product/goods together with the adapter; if the adapter is not included, testing under QCVN 132:2022/BTTTT shall be conducted on the product/goods without the adapter.
(11) For QCVN 133:2024/BTTTT: the EIRP requirements under Article 2.2.2.7 and OTA Receiver Sensitivity (EIS) under Article 2.2.2.13 of the technical regulation shall not apply.
(12) In cases where products/goods specified in Section II of Appendix I issued together with this Circular are integrated into products/goods specified in Section II of Appendix II issued together with this Circular, the integrated product/goods shall be subject to the quality management measures applicable to medium-risk products/goods, but must fully satisfy the corresponding national technical regulations applicable to the main product/goods as well as to the integrated components, parts, and functions.
Relevant organizations and individuals must carry out certification of conformity to regulations or self-assessment of conformity to the corresponding technical regulation, and declare conformity to regulations in accordance with laws on standards and technical regulations, laws on product and goods quality, and the corresponding national technical regulations.
(13) For products/goods applying Method 3 under Circular No. 14/2026/TT-BKHCN, the certification body is exempted from assessing the production process at the manufacturing site if the product is manufactured on a production line already certified as conforming to a valid quality management system standard, with a scope consistent with the product/goods being assessed; this applies to both domestically manufactured products and imports. Sampling for testing and conformity assessment shall be carried out in accordance with Circular No. 14/2026/TT-BKHCN, the corresponding national technical regulations, and laws on quality of product and goods./.
