Summary of Key Changes Under Circular 29/2025/TT-BKHCN

  • The requirement for testing under harsh environmental conditions is abolished from July 1, 2025, for several technical regulations, most notably QCVN 55:2023/BTTTT. Products subject to these regulations will only need to undergo testing under normal conditions, applicable to both imported goods and products registered for state quality inspection from July 1, 2025.
  • Testing under extreme conditions for QCVN 54:2020/BTTTT and QCVN 65:2021/BTTTT is only required for Wi-Fi modems and Access Points (HS code 85176251). Other products (with different HS codes) may apply QCVN 54:2020/BTTTT and QCVN 65:2021/BTTTT under normal testing conditions during the transitional period from July 1, 2025 to December 15, 2026.
  • The requirement to test the 2G / 2.5G section of QCVN 117:2023/BTTTT is removed for land mobile terminal equipment. However, land mobile base stations and repeaters using GSM or EGPRS technologies remain subject to conformity certification for 2G / 2.5G.
  • The application of several technical regulations will be suspended entirely until December 15, 2026, especially those applicable to maritime equipment. Products under these regulations will not be required to undergo testing, applicable to both imported goods and products registered for state quality inspection from July 1, 2025.
  • Industrial computers under HS code 84714090 are newly added to the list of products subject to mandatory conformity declaration (and conformity certification if they feature radio transmission capabilities).
  • State management philosophy shifts from “pre-check” to “post-check” for products related to radio spectrum planning. Under Circular 29/2025/TT-BKHCN, enterprises are no longer required to submit a “manufacturer’s letter confirming frequency compliance for WiFi 6E and WiFi 7 bands.”

Circular 29/2025/TT-BKHCN takes effect and replaces Circular 02/2024/TT-BTTTT from December 31, 2025.

Key Considerations When Applying Circular 29/2025/TT-BKHCN

  • Flycams and UAVs using WLAN/RLAN technology are required to undergo conformity certification only when their 5GHz transmit power ranges between 60 mW and 200 mW. Meanwhile, Circular 08/2021/TT-BTTTT allows the use of the 5725–5850 MHz band with transmit power up to 1000 mW. This raises important questions:

1. Are Flycam and UAV products operating in the 5GHz band with transmit power above 200 mW required to undergo conformity certification?

2. Is this power limit part of a roadmap to tighten transmit-power conditions for 5GHz WLAN/RLAN-based Flycams and UAVs to meet safety, security, and national-defense requirements?

  • Industrial computers under HS code 84714090 are newly added to the list of products subject to conformity declaration (and conformity certification if they include radio-transmitting functions). However, the English version of the Circular labels them as “Desktop Computer”, which may imply that only desktop-type industrial computers fall under this requirement. The Circular does not clarify whether non-desktop industrial PCs (e.g., units mounted on manufacturing lines or built into automated systems for data analysis and processing) are also subject to conformity obligations.
  • Enterprises are no longer required to submit a manufacturer’s confirmation letter regarding WiFi 6E or WiFi 7 frequency bands. However, manufacturers and importers must exercise caution: if the actual imported product does not meet the spectrum-planning and usage conditions stipulated in Circular 08/2021/TT-BTTTT, the product may be deemed non-compliant and must be returned to the supplier.
  • General-purpose radio transmitters operating at 125 kHz and 134.2 kHz fall under Section 2.2 of Annex 1 of Circular 29/2025/TT-BKHCN — meaning they require conformity certification (and conformity declaration). These devices are also covered by QCVN 55:2023/BTTTT. However, the Telecommunications Quality Measurement Center does not certify these products, citing that Annex 3 of Circular 08/2021/TT-BTTTT — governing license-exempt short-range devices — does not allocate the 125 kHz and 134.2 kHz center frequencies for general-purpose radio use.
  • Notably, induction loop devices (a type of short-range radio device, though not explicitly listed in Circular 02/2024/TT-BTTTT) may also operate on the 125 kHz and 134.2 kHz frequencies. This creates potential confusion and regulatory obstacles for enterprises: products listed under Section 2.2 of Annex 1 of Circular 29/2025 may be required to obtain conformity certification, yet may be unable to do so — resulting in compliance deadlock during state quality inspection procedures.

Regulation on the List of products and articles likely to cause safety risks in the field of information technology and telecommunications under the management of the Ministry of Science and Technology

 

Pursuant to the Law on Product and Goods Quality dated 21 November 2007;

Pursuant to the Law on Standards and Technical Regulations dated 29 June 2006;

Pursuant to the Law on Telecommunications dated 24 November 2023;

Pursuant to the Law on Radio Frequency dated 23 November 2009; and the Law amending and supplementing a number of articles of the Law on Radio Frequency dated 09 November 2022;

Pursuant to the Law on Information Technology dated 29 June 2006;

Pursuant to Decree No. 132/2008/ND-CP dated 31 December 2008 of the Government detailing the implementation of a number of articles of the Law on Product and Goods Quality, and Decree No. 74/2018/ND-CP dated 15 May 2018 of the Government amending and supplementing a number of articles of Decree No. 132/2008/ND-CP detailing the implementation of a number of articles of the Law on Product and Goods Quality;

Pursuant to Decree No. 154/2018/ND-CP dated 09 November 2018 of the Government amending, supplementing, and removing a number of regulations on investment and business conditions under the state management of the Ministry of Science and Technology and several provisions on specialized inspection;

Pursuant to Decree No. 55/2025/ND-CP of the Government defining the functions, duties, powers, and organizational structure of the Ministry of Science and Technology;

At the request of the Chairperson of the National Standardization, Metrology and Quality Council,

The Minister of Science and Technology hereby promulgates this Circular providing the List of products and articles likely to cause safety risks in the field of information technology and telecommunications under the management of the Ministry of Science and Technology.

Article 1. Scope of regulation

1. This Circular stipulates the List of products and articles that may pose safety risks in the field of information technology and telecommunications under the management responsibility of the Ministry of Science and Technology (hereinafter referred to as Group-2 products and articles); the principles for managing Group-2 products and articles; and provisions on certain cases where the effectiveness of, or the mandatory application of, part or all of certain technical regulations is suspended.

2. This Circular applies only to products and articles with HS codes and product descriptions specified in the List of Group-2 products and articles.

Article 2. Regulated entities

This Circular applies to:

1. Organizations and individuals engaged in the manufacture or trading of products and articles listed as Group-2 products and articles in Vietnam.

2. Organizations and individuals involved in activities related to the quality management of products and articles listed as Group-2 products and articles in Vietnam.

Article 3. List of Group-2 products and articles

The List of Group-2 products and articles and the corresponding management measures are defined as follows:

1. The List of information technology and telecommunications products and articles subject to compulsory conformity certification and conformity declaration is provided in Annex I issued together with this Circular.

2. The List of information technology and telecommunications products and articles subject to compulsory conformity declaration is provided in Annex II issued together with this Circular.

Article 4. Principles for managing Group-2 products and articles

1. The quality management of products and articles listed as Group-2 is carried out in accordance with the regulations of the Ministry of Science and Technology on conformity certification, conformity declaration, and quality inspection for information technology and telecommunications products and articles, as well as the corresponding technical regulations.

2. Products and articles listed as Group-2 that incorporate other products or articles also listed as Group-2 must undergo conformity certification and conformity declaration for all applicable technical regulations corresponding to both the primary product and the integrated products.

3. Products and articles listed as Group-2 that fall under the scope of two or more technical regulations must undergo conformity certification and conformity declaration in accordance with all such technical regulations.

4. In cases where a technical regulation issued before the effective date of this Circular contains provisions that differ from those of this Circular, the provisions of this Circular shall prevail.

5. From the effective date of this Circular, if a new technical regulation is issued to replace a technical regulation listed in the Group-2 product and article list, or if a new technical regulation is newly issued to additionally apply to products and articles listed in the Group-2 list, the provisions of the Circular issuing the new technical regulation shall apply.

Article 5. Effectiveness

1. This Circular takes effect from 31 December 2025.

2. Circular No. 02/2024/TT-BTTTT dated 29 March 2024 of the Minister of Information and Communications on the List of products and articles likely to cause safety risks under the management of the Ministry of Information and Communications shall cease to be effective from the effective date of this Circular.

Article 6. Transitional provisions

Certificates of conformity and Notifications of receipt of conformity declarations issued for products and articles within the scope of this Circular prior to its effective date shall remain valid until the expiry date stated in the Certificates of conformity or Notifications of receipt of conformity declarations.

This Circular shall apply until the List of products and articles classified by risk levels is issued in accordance with the law on product and goods quality.

Article 7. Implementation

1. The Chief of the Office, the Chairperson of the National Standardization, Metrology and Quality Council, the heads of units under the Ministry of Science and Technology, and relevant organizations and individuals are responsible for implementing this Circular.

2. During the implementation of this Circular, organizations and individuals must promptly report any difficulties or obstacles and comply with the guidance of the Ministry of Science and Technology.

(4) For QCVN 117:2023/BTTTT: the following shall not apply—Total Radiated Sensitivity (TRS) requirements under Clause 2.2.12 and Total Radiated Power (TRP) requirements under Clause 2.2.13, as well as Items B.2.2.18 and B.2.2.19 of the technical regulation; and technical requirements for GSM (2G and 2.5G) technology.

(5) For QCVN 101:2020/BTTTT: only the safety characteristic requirements in Clause 2.6 of this technical regulation are required for conformity declaration.

(6) For QCVN 65:2021/BTTTT: the formula (1) in Clause 2.1.2 shall not apply.

(9) Test results from domestic or foreign laboratories that have not been designated or recognized, as well as manufacturer-provided test results, shall not be used for conformity assessment under this technical regulation.

(10) For QCVN 132:2022/BTTTT: where the product or article uses a power adapter, if the adapter is supplied with the product, testing under QCVN 132:2022/BTTTT shall be performed with the adapter; if the adapter is not supplied, testing shall be performed without the adapter.

(11) For QCVN 133:2024/BTTTT: the requirements on Radiated Emission Power (EIRP) in Clause 2.2.2.7 and Over-the-Air Receiver Sensitivity (EIS) in Clause 2.2.2.13 shall not apply.

(12) For QCVN 18:2022/BTTTT: test results from foreign laboratories may be accepted for products with large size/weight (300 kg or more) and using three-phase power. The foreign laboratory must be accredited by an organization that is a member of APAC or ILAC in accordance with ISO/IEC 17025.
