EXTENDMAX – 11/05/2026 – To provide detailed guidance and implement the 2025 amended Law on Product and Goods Quality together with Government Decree No. 37/2026/ND-CP, the Ministry of Science and Technology recently issued Circular No. 14/2026/TT-BKHCN dated April 9, 2026. This Circular establishes an entirely new legal framework for conformity certification and standards certification applicable to medium-risk and high-risk products and goods. While this new framework may appear to be only a minor adjustment, it actually has a major and far-reaching impact on conformity certification for risk-classified products and goods (formerly known as Group 2 products), particularly radio transmitting/receiving devices and ICT equipment.
Circular No. 14/2026/TT-BKHCN: An Entirely New Legal Framework for Conformity Certification Applicable to Risk-Classified Products and Goods
Below are several key changes to the legal framework for standards and conformity certification from the perspective of legal expert Tran Thanh Phuong – CEO of ExtendMax:
Core Changes to Standards and Conformity Certification under Circular No. 14/2026/TT-BKHCN:
- Clause 3, Article 6: Certification Method 1 (type testing) and Method 6 are no longer applicable to high-risk products and goods. This means high-risk products must undergo conformity certification based on methods involving production process assessment (factory audit) or batch-by-batch certification. This change may significantly affect certain product categories that were previously allowed to apply Certification Method 1 but are now classified as high-risk goods.
- Clause 5, Article 6: The Ministry of Science and Technology permits the use of representative sample testing for a product type (which may be understood as a group of highly similar products or a model series) to certify products belonging to that same group or series. Detailed sampling requirements must be specifically regulated in the relevant technical regulations or other legal documents, and enterprises must possess a certified quality management system (such as ISO 9001, HACCP, GMP, etc.).
- Conformity Declaration procedures will now be centralized and registered online through the National Database System. The conformity declaration result (confirmation code verifying completion of the conformity declaration registration) will also be issued via the National Database online portal.
- This Circular takes effect on May 25, 2026. Certificates of standards conformity, certificates of conformity, and conformity declarations issued prior to the effective date of this Circular will remain valid until their expiration dates stated on the certificates.

ON DECLARATION OF CONFORMITY TO STANDARDS, DECLARATION OF CONFORMITY TO TECHNICAL REGULATIONS AND ASSESSMENT METHOD FOR CONFORMITY TO STANDARDS, TECHNICAL REGULATIONS
Pursuant to the Law on Standards and technical Regulations No. 68/2006/QH11 amended by the Law No. 35/2018/QH14 and the Law No. 70/2025/QH15;
Pursuant to the Law on Product and Goods Quality No. 05/2007/QH12 amended by the Law No. 78/2025/QH15;
Pursuant to Decree No. 22/2026/ND-CP dated January 16, 2026 of the Government elaborating the Law on Standards and Technical Regulations;
Pursuant to Decree No. 37/2026/ND-CP dated January 23, 2026 of the Government elaborating the Law on Product and Goods Quality;
Pursuant to Decree No. 55/2025/ND-CP dated March 02, 2025 of the Government on functions, tasks, powers, and organizational structures of Ministry of Science and Technology;
At request of Director of Commission for Standards, Metrology, and Quality of Vietnam;
The Minister of Science and Technology promulgates Circular on declaration of conformity to standards, declaration of conformity to regulations and assessment method for conformity to standards and technical regulations.
This Circular prescribes declaration of conformity to standards, declaration of conformity to regulations and assessment method for conformity to standards and technical regulations.
This Circular applies to organizations, individuals, and authorities related to assessment of conformity, declaration of conformity to standards, declaration of conformity to regulations.
In this Circular, the terms below are construed as follows:
1. Certification body for standard conformity refers to an organization that conducts assessment and verifies that eligibility of operation in standard sector conforms to corresponding standards.
2. Assessment body for regulation conformity refers to an organization that conducts assessment and verifies that eligibility of operation in technical regulation sector conforms to corresponding technical regulations.
3. Make of product and goods refers to a specific product, goods that is recognized by code, name, or trademark of manufacturer and identified by a combination of specific technical specifications.
4. Type of product and goods refers to a combination of products, goods with the same characteristics, functionalities, composition, basic design, technical structure, operating principles where design characteristics are primary elements in deciding conformity of product, goods type with similarly applicable technical and safety requirements despite differences in terms of specific technical specifications.
5. Group of product and goods refers to a combination of products, goods consisting of one or multiple types and/or makes with similarities in characteristics, functions, composition, basic design, operating principles, and primary purpose of use where differences between products in the group do not alter conformity to technical and safety requirements.
Article 4. Mark of conformity to standards, mark of conformity to regulations
1. Mark of conformity to standards and use thereof
Shape, structure, presentation, and use of mark of conformity to standards issued to entities eligible for certification of conformity to standards shall be prescribed by certification body and satisfactory to basic requirements below:
a) Mark of conformity to standards must be clear and distinguishable from other marks;
b) Mark of conformity to standards must include, in full, code of corresponding standards or incorporated with measures that grant access to information on code of standards that are used as the basis for certification of conformity to standards.
The use of mark of conformity shall conform to guidelines under TCVN ISO/IEC 17030. Where organizations and individuals declare conformity to standards on the basis of self-assessment, mark of conformity to standards must not be used.
2. Mark of conformity to regulations and use thereof
a) Shape and dimensions of mark of conformity to regulations shall conform to Appendix I hereof; mark of conformity to regulations shall be used for subjects of certification of conformity to regulations;
b) Mark of conformity to regulations shall be appended directly onto products, goods, packaging, technical dossiers, or label of products and goods;
c) Mark of conformity to regulations shall be located where it can be seen, read with ease, cannot be easily altered, and cannot be removed then appended again;
d) Mark of conformity to regulations can be scaled up or down as long as basic dimension proportions according to Appendix I hereof are maintained and the mark is distinguishable to the naked eyes;
dd) Mark of conformity to regulations must be designed and presented in the same color and must be distinguishable;
e) Where products and goods are regulated by multiple technical regulations, mark of conformity shall only be issued if the products and goods satisfy corresponding technical regulations;
g) Where organizations and individuals use electronic product label, mark of conformity to regulations must also be incorporated in electronic product label. Point b and Point c of this Clause are not mandatory in case organizations and individuals use electronic label.
Article 5. Certification methods
1. Certification of conformity shall be carried out via any of the methods below:
a) Method 1: Certification via testing samples representative of product and goods make, type;
b) Method 2: Certification via testing samples representative of product and goods make, type. Supervising via testing samples collected on the market;
c) Method 3: Certification via testing samples representative of product and goods make, type and assessing production process. Supervising via testing samples and assessing production process. Test samples shall be collected at production sites;
d) Method 4: Certification via testing samples representative of product and goods make, type and assessing production process. Supervising via testing samples and assessing production process. Test samples shall be collected at production sites and/or from the market;
đ) Method 5: Certification via testing samples representative of product and goods make, type and assessing production process or management system. Supervising via testing samples and assessing production process or management system. Test samples shall be collected at production sites and/or from the market;
e) Method 6: Certification via assessing and supervising management system;
g) Method 7: Certification via testing, assessing shipment of product and goods;
h) Method 8: Certification via testing or inspecting products and goods in their entirety.
2. Details, procedures, and use principles of methods for certification of conformity are prescribed under Appendix II hereof.
3. Ministries governing fields, sectors, and certification bodies may adopt methods other than those mentioned above as long as compliance with TCVN ISO/IEC 17067 and international practices is maintained.
Article 6. Adoption principles of certification methods
1. Methods for certifying conformity to technical regulations applicable to products, goods, services, processes, environment, or other subjects in specific socio-economic activities prescribed under corresponding technical regulations or relevant field-specific legislative documents. Certification methods must be specified on certificate of conformity to technical regulations.
2. Ministries governing fields, sectors, People’s Committees of provinces and cities (hereinafter referred to as “provincial People’s Committee”) shall, on the basis of risk level of products and goods, prescribe adoption of certification methods in corresponding technical regulations.
3. Methods 1 and Method 6 under Article 5 and Appendix II hereof do not apply to products and goods with high risk levels.
4. Collection of product and goods samples on the market for test that is appropriate to criterion or criteria under corresponding technical regulations shall only be carried out if characteristics of products and goods can be altered during distribution and sale on the market.
5. In respect of certification methods that require testing of samples representative of product and goods make and type, permission to collect samples representative of product and goods type in lieu of samples for each product and goods make or collect samples representative of product and goods group in lieu of samples for each product and goods type and make must be specified by governing ministries and provincial People’s Committee under corresponding technical regulations or relevant legislative documents in a manner that adheres to principles below:
a) Such permission only applies to products and goods with average risk levels;
b) According to field-specific regulations applicable to the products and goods that dictate management solutions, technical criteria of products and goods must undergo adequate testing according to requirements under corresponding technical regulations before the goods and products are introduced to market circulation for the first time;
c) Organizations and enterprises have been certified for quality control system satisfactory to corresponding standards (ISO 9001, HACCP, GMP, other standards on quality control system) where the scope of certification concerns product and goods eligibility. Certification bodies must be accredited by accreditation bodies that are signatories of Mutual Recognition Arrangements or Multilateral Recognition Arrangements (MRA/MLA) and members of global or regional accreditation cooperation (Global Accreditation Cooperation Incorporated, organizations acquired by International Laboratory Accreditation Cooperation (ILAC) and International Accreditation Forum (IFA); Asia Pacific Accreditation Cooperation (APAC)) or organizations recognized under MRA/MLA to which Vietnam is a signatory.
6. Where certification methods require collection of samples for testing in supervision of products and goods with average or high risk levels, governing ministries and provincial People’s Committees shall prescribe under corresponding technical regulations on reduction, exemption of test sample quantities or reduction, exemption of test criteria. Reduction and exemption of test sample quantities or reduction and exemption of test criteria under this Clause in assessment periods shall only be implemented if requirements below are met:
a) Organizations and enterprises are capable of providing adequate proof pertaining to ongoing application of and certification for quality control appropriate to corresponding standards (ISO 9001, HACCP, GMP, other standards on quality control system). Certification bodies must be accredited by accreditation bodies that are signatories of Mutual Recognition Arrangements and Multilateral Recognition Arrangements (MRA/MLA) and members of international or regional accreditation cooperation (Global Accreditation Cooperation Incorporated; APAC) or accreditation bodies that are recognized by MRA/MLA to which Vietnam is a signatory;
b) Adoption of quality control system under Clause 7 of this Article shall require organizations and enterprises to implement supervision, internal test programs for products and goods that are subject to reduction or exemption from testing or require organizations and enterprises to perform tests on products and goods that are subject to reduction or exemption from testing at request of relevant parties (customers, authorities, other parties);
c) All tests under Point b of this Clause must be conducted at accredited testing bodies;
d) Products and goods specified in corresponding technical regulations must undergo testing and supervision for all criteria at least once per certification cycle;
7. Where certification methods require assessment of production process in respect of supervision of products and goods with average and high risk levels, governing ministries and provincial People’s Committees shall specify the reduction and exemption from requirement for assessment of production process in corresponding technical regulations. Regulations under this Clause only apply if organizations and enterprises are capable of providing adequate proof pertaining to ongoing application of and certification for quality control appropriate to corresponding standards (ISO 9001, HACCP, GMP, other standards on quality control system).
8. Certificate of quality control system satisfactory to corresponding standards under Clauses 5, 6, and 7 of this Article must satisfy requirements below:
a) The certificate has at least 6 months in effective period on the date on which reduction, exemption is being considered;
b) Scope of certification appropriate to the products and goods is specified under technical regulations;
c) The certificate is issued by certification bodies that have been accredited by accreditation bodies that are signatories of Mutual Recognition Arrangements and Multilateral Recognition Arrangements (MRA/MLA) and members of international or regional accreditation cooperation (Global Accreditation Cooperation Incorporated; APAC) or accreditation bodies that are recognized by MRA/MLA to which Vietnam is a signatory;
9. Where method 7 is adopted for the purpose of certification of products and goods, governing ministries and provincial People’s Committees, on the basis of risk levels and technical characteristics of products and goods, shall specify collection of samples of products and goods representative of product and goods make, type, group in corresponding technical regulations. Where technical regulations dictate collection of samples representatives of product and goods shipments on the basis of probability sampling, such technical regulations must clearly specify sampling methods according to national standards and international standards on probability sampling for corresponding shipments (TCVN 9597-1 or ISO 10576-1, TCVN 7790 or ISO 2859, TCVN 8243-1 or ISO 3951-1).
10. Methods for certifying conformity to standards applicable to each product, goods, service, process, environment, or other subject in specific socio-economic activities shall be selected by certification bodies or organizations, individuals declaring conformity to standards on the basis of conformity assessment methods under Article 5 hereof. Selected certification methods must be appropriate to risk levels of subjects of assessment in order to ensure reliability of certification results. In respect of certification of conformity to standards, adoption of principles under Clauses 2, 3, 4, 5, 6, 7, 8, and 9 of this Article shall be decided by certification bodies. Certificate of conformity to standards must specify certification method. Mark of conformity to standards shall not be issued for method 1.
DECLARATION OF CONFORMITY TO STANDARDS
Article 7. Principles of declaration of conformity to standards
1. Subjects of declaration of conformity to standards are products, goods, services, processes, environment, or other subjects in socio-economic activities prescribed in corresponding standards.
Declaration of conformity to standards shall be a voluntary activity.
2. Declaration of conformity to standards is based on:
a) Results of conformity certification conducted by registered or accredited certification bodies;
b) Results of conformity self-assessment of organizations and individuals declaring conformity to standards.
Tests that serve conformity assessment shall be conducted at registered or accredited testing bodies.
Article 8. Assessment of conformity to standards
1. Assessment of conformity of products, goods, services, processes, environment, or other subjects in socio-economic activities to corresponding standards shall be assessment of conformity to standards.
a) Assessment of conformity to standards shall be conducted by registered or accredited certification bodies or organizations, individuals declaring conformity to standards.
b) Certification of conformity to standards shall be carried out in accordance with methods under Article 5 hereof;
2. Results of assessment under Point a Clause 1 of this Article shall serve as the basis to enable organizations and individuals to declare conformity to standards.
Article 9. Procedures for declaring conformity to standards
Declaration of conformity to standards shall be implemented as follows:
1. Step 1: Organizations and individuals shall complete notice of declaration of conformity using Form under Appendix III attached hereto.
Organizations and individuals have the right to select and list all standards applicable to products, goods, services, processes, environment or other subjects in their socio-economic activities in their notice of declaration of conformity to standards.
Organizations and individuals responsible for products, goods, services, processes, environment, and other subjects in socio-economic activities must countersign notice of declaration of conformity to standards.
2. Step 2: Organizations and individuals shall send notice of declaration of conformity to standards via national database on standards, metrology, and quality; receive confirmation code for successful submission of notice of declaration of conformity to standards on the national database on standards, metrology, and quality.
Where national database on standards, metrology, and quality encounters errors or is not finished in terms of infrastructures, organizations and individuals shall submit notice of declaration of conformity to standards to local field-specific authority either in person or via post service. Local field-specific authorities have the responsibility to update notice of declaration of conformity to standards on national database on standards, metrology, and quality. Where local field-specific authorities are not available, agencies affiliated to governing ministries appointed or delegated by ministers shall receive declaration of conformity to standards submitted by organizations and individuals.
Article 10. Responsibilities of organizations and individuals declaring conformity to standards
1. Choose conformity assessment methods appropriate to subjects of declaration of conformity to standards in order to ensure reliability of assessment results.
2. Maintain and assume responsibility for conformity of products, goods, services, processes, environment, or other subjects in socio-economic activities that have been declared for conformity to standards; maintain quality control, testing, and periodic supervision at manufacturing, business facilities of organizations and individuals.
3. Where non-conformity is found in products, goods, services, processes, environment, or other subjects in socio-economic activities that have been declared for conformity to standards during sale or use, organizations and individuals declaring conformity shall exercise responsibility and obligation according to the Law on Product and Goods Quality.
4. Prepare and store declaration of conformity to standards as follows:
a) Where declaration of conformity is based on certification of conformity to standards issued by certification bodies, organizations and individuals have the responsibility to prepare and store declaration of conformity to standards which includes: original copies of certificate of conformity to standards; certification documents of certification bodies; notice of declaration of conformity to standards and confirmation of notice of declaration of conformity to standards on the national database on standards, metrology, and quality.
b) Where declaration of conformity to standards is based on self-assessment results of manufacturing, business organizations and individuals, the organizations and individuals have the responsibility to prepare and store declaration of conformity to standards which includes: original copies of self-assessment documents of organizations and individuals; notice of declaration of conformity to standards and confirmation of notice of declaration of conformity to standards on the national database on standards, metrology, and quality.
c) Self-assessment documents consist of:
- General description of products, goods, services, processes, environment, or other subjects in socio-economic activities (functions, uses, structures, basic technical specifications; design dossiers, diagrams, photos, labels, packaging); manufacturing process, procedures, including information on materials, technology, and quality control system (if applicable);
- Information on test methods, test results; results of comparison with requirements of corresponding standards;
- Other relevant documents (if required according to corresponding standards);
- Self-assessment reports of organizations and individuals countersigned by competent or authorized persons.
5. Provide documents proving compliance of products, goods, services, processes, environment, or other subjects of socio-economic activities with corresponding standards at request of competent authorities.
6. Follow through with declaration procedures again in case of changes to details of standards, changes to details of declaration of conformity to standards or changes to functionalities, uses, characteristics of products, goods, and services that have been declared for conformity to standards.
DECLARATION OF CONFORMTIY TO REGULATIONS
Article 11. Principles of declaration of conformity to regulations
1. Subjects of declaration of conformity to regulations are products, goods, services, processes, environment, or other subjects in socio-economic activities under national technical regulations promulgated by governing ministries or local technical regulations promulgated by provincial People's Committees.
Declaration of conformity to regulations is mandatory.
2. On the basis of risk levels of products, goods, services, processes, environment, or other subjects in socio-economic activities, declaration of conformity to corresponding technical regulations is based on:
a) Certification results of conformity to regulations of designated certification bodies as per the law;
b) Certification results of conformity to regulations of accredited certification bodies as per the law;
c) Self-assessment results of organizations and individuals on the basis of test results of accredited or designated testing bodies as per the law.
d) Assessment results of conformity of recognized international, regional, foreign organizations as per the law.
3. In respect of products and goods that are exempted from declaration of conformity to regulations under Clause 2 Article 48 of the Law on amendment to the Law on Standards and Technical Regulations, requirements pertaining to quality control and safety under field-specific laws.
Article 12. Assessment of conformity to technical regulations
1. Assessment of conformity of products, goods, services, processes, environment, or other subjects in socio-economic activities to corresponding technical regulations shall be assessment of conformity to regulations.
a) Assessment of conformity to regulations shall be conducted by certification bodies or organizations, individuals on the basis of risk levels or and quality control principles according to regulations of the law on product and goods quality.
b) In case of certification by certification bodies, certification operation shall conform to Article 6 Appendix II hereof;
2. Results of assessment under Point a Clause 1 of this Article shall serve as the basis to enable organizations and individuals to declare conformity to regulations.
Article 13. Procedures for declaring conformity to regulations
Declaration of conformity to regulations shall be implemented as follows:
1. Step 1: Organizations and individuals shall complete registration for declaration of conformity to regulations using form under Appendix IV attached hereto.
Organizations and individuals have the responsibility to identify and list all corresponding, mandatory technical regulations applicable to products, goods, services, processes, environment, or other subjects in their socio-economic activities in registration for declaration of conformity to regulations.
Organizations and individuals responsible for products, goods, services, processes, environment, and other subjects in socio-economic activities must countersign registration for declaration of conformity to regulations.
2. Step 2: Organizations and individuals shall register conformity to regulations via the national database on standards, metrology, and quality; receive confirmation code for successful registration of declaration of conformity to regulations on the national database.
Attachments include:
- Electronic copies of certificate of conformity to corresponding technical regulations issued by certification bodies to organizations and individuals in case of declaration of conformity to regulations based on certification results of certification bodies.
- Self-assessment reports for conformity to regulations (using form under Appendix V attached hereto) and electronic copies of test results regarding conformity to technical regulations of designated or accredited testing bodies in accordance with corresponding technical regulations in case declaration of conformity to regulations is based on self-assessment results of organizations and individuals.
Where national database on standards, metrology, and quality encounters errors or is not finished in terms of infrastructures, organizations and individuals shall register for declaration of conformity to regulations by submitting regulations to local field-specific authority either in person or via post service. Local field-specific authorities have the responsibility to update registration of declaration of conformity to regulations on national database on standards, metrology, and quality. Where local field-specific authorities are not available, ministry-affiliated agencies and ministerial agencies of governing ministries designated or delegated by ministers, figureheads of ministerial agencies shall receive declaration of conformity to regulations of organizations and individuals.
Article 14. Responsibilities of organizations and individuals declaring conformity to regulations
1. Notify declaration of conformity to regulations via appropriate means of communication in a manner that allows users of products and goods to access with ease.
2. Maintain and assume responsibility for conformity of products, goods, services, processes, environment, or other subjects in socio-economic activities where declaration of conformity to regulations applies; maintain quality control, testing, and periodic supervision.
3. Use mark of conformity to regulations on products and goods that have been declared for conformity to regulations under Clause 2 Article 4 hereof before introducing for market circulation. Record via the use of logbooks and file annual reports on use of mark of conformity to regulations to certification bodies.
4. Where non-conformity is found in products, goods, services, processes, environment, or other subjects in socio-economic activities that have been declared for conformity to regulations during sale or use, organizations and individuals declaring conformity shall exercise responsibility and obligation according to the Law on Product and Goods Quality.
5. Prepare and store declaration of conformity to regulations in order to enable inspection and examination of state authorities as follows:
a) Where declaration of conformity to regulations is based on certification results of certification bodies, organizations and individuals have the responsibility to file and store declaration of conformity to regulations which includes: original copies of certificate of conformity to regulations; certification of certification bodies; registration for declaration of conformity to regulations and confirmation of registration for declaration of conformity to regulations on the national database on standards, metrology, and quality.
b) Where declaration of conformity to regulations is based on self-assessment results of manufacturing, business organizations and individuals, organizations and individuals have the responsibility to prepare and store declaration of conformity to regulations which includes: physical copies of registration for declaration of conformity to regulations on the national database on standards, metrology, and quality.
c) Self-assessment documents consist of:
- General description of products, goods, services, processes, environment, or other subjects in socio-economic activities (functions, uses, structures, basic technical specifications; design dossiers, diagrams, photos, labels, packaging); manufacturing process, procedures, including information on materials, technology, and quality control system (if applicable).
- Report on test methods and results; comparison with requirements of corresponding technical regulations and copies of test results of accredited, designated, or recognized testing bodies as per the law.
- Quality control plans appropriate to technical regulations, periodic supervision; test and examination frequency, methods, and solutions for maintaining conformity to corresponding technical regulations.
- Other relevant documents (if required by corresponding technical regulations).
- Self-assessment reports of organizations and individuals that have been countersigned.
6. Provide documents proving conformity of products, goods, services, processes, environment, or other subjects of socio-economic activities with corresponding technical regulations at request of competent authorities.
7. Follow through with procedures for declaration again in case of changes pertaining to contents of technical regulations, registered declaration of conformity to regulations or functions, uses, characteristics of products, goods, and services that have been declared for conformity to regulations.
Article 15. Responsibility of authorities
1. The Ministry of Science and Technology has the responsibility to:
a) assist the Government in joint management and guidance of conformity assessment, declaration of conformity to standards, and declaration of conformity to regulations;
b) cooperate and guide governing ministries, provincial People’s Committees in determining risk levels of products, goods and appropriate management solutions in corresponding technical regulations promulgated by governing ministries and provincial People’s Committees in a manner compliant with conformity declaration principles under the Law on Standards and Technical Regulations;
c) designate agencies that receive declaration of conformity to regulations to manage declaration of conformity to regulations in relevant sectors of governance operations;
d) cooperate with governing ministries and provincial People’s Committees in expediting, guiding declaration of conformity to standards, declaration of conformity to regulations in accordance with this Circular;
dd) monitor declaration of conformity to standards and declaration of conformity to regulations for products, goods, services, processes, environment, or other subjects in socio-economic activities within authority of the Ministry of Science and Technology, governing ministries, and provincial People’s Committees; monitor designation made by governing ministries in conformity assessment, declaration of conformity to standards, declaration of conformity to regulations;
e) coordinate and share data of the national database on standards, metrology, and quality to governing ministries and provincial People’s Committees in service of consolidation, reporting, examination, and inspection.
2. Governing ministries and provincial People’s Committees have the responsibility to:
a) arrange declaration of conformity to regulations in accordance with this Circular upon promulgating corresponding technical regulations;
b) designate agencies that receive declaration of conformity to regulations to manage declaration of conformity to regulations in relevant sectors of governance operations;
c) cooperate with the Ministry of Science and Technology in determining risk levels of products, goods, and appropriate management solutions in corresponding technical regulations promulgated by governing ministries and provincial People’s Committees in a manner compliant with declaration principles under the Law on Standards and Technical Regulations;
d) manage and monitor registration for declaration of conformity to regulations of agencies designated by governing ministries and provincial People’s Committees;
dd) cooperate with the Ministry of Science and Technology in management of declaration of conformity to standards, declaration of conformity to regulations at governing ministries and provincial People’s Committees.
1. This Circular comes into force from May 25, 2026.
2. The following Circulars expire from the effective date hereof:
- Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology.
- Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Minister of Science and Technology.

Article 17. Transition clauses
1. Organizations and individuals that have conducted assessment of conformity to standards, technical regulations, declaration of conformity to standards, declaration of conformity to regulations before the effective date hereof shall be allowed to use certificate of conformity to standards, certificate of conformity to regulations, mark of conformity to standards, mark of conformity to regulations until expiry and shall not be required to submitting notice of declaration of conformity to standards again or registering declaration of conformity to regulations again.
Article 18. Organizing implementation
1. Ministers, heads of ministerial agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities are responsible for organizing implementation of this Circular.
2. Director of Commission for Standards, Metrology, and Quality of Vietnam has the responsibility to guide and arrange implementation of this Circular.
3. Difficulties that arise during implementation of this Circular should be promptly reported to the Ministry of Science and Technology in writing./.

DETAILS, PROCEDURES, AND ADOPTION PRINCIPLES OF CERTIFICATION METHODS
I. Method 1: Certification via testing samples representative of product and goods make, type
Method 1 prescribes testing of samples representative of product and goods make, type in order to certify conformity. Certification of conformity applies to make, type of products and goods of which representative samples have been collected for testing.
1. Details and procedures of primary activities in method 1:
1.1. Collecting samples:
- Determine make, type of products and goods.
- Collect samples representative of product and goods make, type.
- Collect sufficient unit quantity of product, goods of samples for testing and sample storage.
1.2. Testing samples:
a) Test samples in service of certification for conformity to standards
Tests of samples in service of conformity certification shall be conducted at testing bodies that have registered for testing operation as per the law, including testing bodies of manufacturers. Encourage certification bodies to employ accredited or designated testing bodies.
b) Test samples in service of certification of conformity
Tests of samples in service of certification of conformity shall be conducted at accredited or designated testing bodies in accordance with regulations on standards and technical regulations, product and goods quality.
c) Properties of products and goods that must be tested and test methods shall be prescribed under corresponding standards and technical regulations.
1.3. Handling results:
Review test results and criteria of samples representatives of product and goods make, type relative to requirements under corresponding standards and technical regulations.
1.4. Certifying conformity
Product and goods make, type shall be considered conforming to requirements of corresponding standards and technical regulations if all test criteria satisfy the corresponding standards and technical regulations.
2. Adoption principles of method 1
Method 1 is adopted to assess conformity of product and goods make, type to standards, technical regulations in case conformity of product and goods make, type primarily depends on design of product and goods make, type.
II. Method 2: Certification via testing samples representative of product and goods make, type. Supervising via testing samples collected on the market
Methods 2 is based on test results of samples representative of product and goods make, type for the purpose of certifying conformity of products and goods. Subsequent assessment and supervision shall be conducted via tests of samples of products and goods on the market.

1.1. Collecting samples:
Proceed as detailed under 1.1 of Method 1.
1.2. Testing samples:
Proceed as detailed under 1.2 of Method 1.
1.3. Handling results:
Review test results concerning criteria of samples representatives of product and goods make, type relative to requirements under corresponding standards and technical regulations.
1.4. Certifying conformity
a) Product and goods make, type shall be considered conforming to requirements of corresponding standards and technical regulations if all test criteria satisfy the corresponding standards and technical regulations.
b) Certificate of conformity of products and goods shall be valid for at most 5 years as long as the products and goods are assessed and supervised as per the laws.
Governing ministries and certification bodies shall, on the basis of risk levels, technical characteristics, level of stability, level of technology, service life, and use nature of products and goods, review and decide specific effective period.
1.5. Supervising:
a) Within effective period of certificate of conformity, products and goods must be assessed and supervised via tests of market samples. Assessment and supervision interval must satisfy principles below:
a1) In respect of products and goods with high risk level, assessment and supervision interval shall not be greater than 12 months from the date on which certificate enters into force; subsequent assessment and supervision interval shall not be greater than 12 months from the date on which the previous assessment and supervision end;
a2) In respect of products and goods with average risk level, assessment and supervision interval shall not be greater than 12 months from the date on which certificate enters into force; subsequent assessment and supervision interval shall not be greater than 24 months from the date on which the previous assessment and supervision end;
a3) In respect of products and goods with low risk level, certification bodies shall decide interval of assessment and supervision on the basis of agreement between certification bodies and assessed organizations, individuals.
b) Tests of product, goods samples shall be compliant with 1.1, 1.2, and 1.3 of Method 1.
c) Assessment and supervision results shall serve as the basis for determining whether to maintain, temporarily suspend, or cancel certification of conformity.
2. Adoption principles of method 2:
Method 2 is adopted to certify conformity of products and goods under the following conditions:
a) Products and goods are subject to possible safety, health, environmental risks;
b) Design of products and goods allow clear determination of products and goods in each make, type;
c) Quality of products and goods can be altered during market distribution and sale;
d) Organizations and individuals producing, trading products and goods take effective measures to retrieve products and goods from the market upon discovering non-conforming products and goods during supervision.
III. Method 3: Certification via testing samples representative of product and goods make, type and assessing production process. Supervising via testing samples and assessing production process. Test samples collected at production sites.
Method 3 is based on results of tests concerning samples representative of product and goods make, type and assessment of production process in order to certify conformity. Assessment and supervision shall be conducted via testing samples and assessing production process. Test samples shall be collected at production sites.

1.1. Collecting samples:
Proceed as detailed under 1.1 of Method 1.
1.2. Assessing conformity of test samples
Proceed as detailed under 1.2 of Method 1.
1.3. Assessing conformity of production process:
Assessment of production process must take into account control conditions of manufacturers relating to creation of products in order to maintain stability of product and goods quality. Control conditions include:
a) Technical documents of products (design documents, technical requirements of products;
b) All production process from input, intermediate stages, and formation of products, including packaging, loading, storage, and transportation;
c) Quality of ingredients, semi-finished products, and finished products;
d) Technology equipment and measuring, examination, and test equipment;
dd) Qualifications and capacity of of employees and technicians;
e) Other necessary technical details.
1.4. Handling results:
- Review test results concerning criteria of samples representatives of product and goods make, type relative to requirements under corresponding standards and technical regulations.
- Review conformity of production process relative to requirements under 1.3 of this Method.
1.5. Certifying conformity:
a) Certify conformity of products and goods relative to requirements under corresponding standards and technical regulations. Products and goods shall be considered conforming if all 2 conditions below are met:
a1) All criteria of test samples conform to corresponding standards and technical regulations;
a2) Assessment results of production process are conforming to requirements.
b) Certificate of conformity of products and goods shall be valid for at most 5 years as long as the products and goods are assessed and supervised as per the laws.

Method 3 is adopted to certify conformity of products and goods under the following conditions:
a) Products and goods have higher safety, health, environmental risks than products and goods under Method 2;
b) Design of products and goods allow clear determination of products and goods in each distinctive make, type;
c) Special attention is given to maintaining quality properties of products and goods during production;
d) Quality of products and goods pertaining to how nature of products and goods changes little or does not change during market circulation and distribution;
dd) Effective measures for recalling non-conforming products and goods from the market are limited.
IV. Method 4: Certification via testing samples representative of product and goods make, type and assessing production process. Supervising via testing samples and assessing production process. Test samples collected at production sites and/or from the market.
Method 4 is based on results of tests concerning samples representative of product and goods make, type and assessment of production process in order to certify conformity. Assessment and supervision shall be conducted via testing samples and assessing production process. Test samples shall be collected at production sites and/or from the market.

a) A highly reliable method similar to Method 5 and allowing wiggle rooms in adoption of supervision solutions should be adopted in order to reduce costs;
b) A widely adopted method should be employed in order to move towards mutual recognition of conformity certification results.
V. Method 5: Certification via testing samples representative of product and goods make, type and assessing production process or management system. Supervising via testing samples and assessing production process or management system. Test samples collected at production sites and/or from the market
Method 5 is based on results of tests concerning samples representative of product and goods make, type and assessment of production process or management system in order to certify conformity. Assessment and supervision shall then be conducted via sample testing and assessment of production process or management system. Test samples shall be collected at production sites and/or from the market

b) Assessing conformity of management system:
- Assessing conformity in terms of document system (Policies, management goals; Management system manual (if any); Procedures, guidelines, forms; Document proof of implementation).
- Assessing implementation and operation of system (Adoption of policies and objectives in practice; Implementation of procedures by process approach and risk-based principles; Control of operation, resources, capacity, and awareness).
- Assessing compliance with requirements of standards, technical regulations, and the law (Identification and compliance with requirements of the law, technical regulations, and standards).
- Assessing internal evaluation and consideration of figureheads (Internal evaluation: Plan, capacity of evaluating personnel, results, monitoring; Consideration of figureheads: commitment, decision on renovation, allocation of resources).
- Determining non-conformity and rectification (Detection and classification of non-conformity; Cause analysis; Rectification and monitoring of effectiveness).
1.4. Handling results:
- Review test results concerning criteria of samples representatives of product and goods make, type relative to requirements under corresponding standards and technical regulations.
- Considering conformity of production process to requirements under 1.3 of Method 3 and/or conformity of management system to requirements under 1.3 of this Method.
1.5. Certifying conformity
a) Certify conformity of products and goods relative to requirements under corresponding standards and technical regulations. Products and goods shall be considered conforming if all 2 conditions below are met:
a1) All criteria of test samples conform to corresponding standards and technical regulations;
a2) Assessment results of production process or management system satisfy requirements.
b) Certificate of conformity of products and goods shall be valid for at most 5 years as long as the products and goods are assessed and supervised as per the laws.
Governing ministries and certification bodies shall, on the basis of risk levels, technical characteristics, level of stability, level of technology, service life, and use nature of products and goods, review and decide specific effective period.

Method 5 is adopted to certify conformity of products and goods under the following conditions:
a) Products and goods have higher safety, health, environmental risks than products and goods certified for conformity under Method 4;
b) Design of products and goods allow clear determination of products and goods in each distinctive make, type;
c) Special attention is given to maintaining quality properties of products and goods during production;
d) Quality of products and goods can lose stability during production and can be altered during market distribution and circulation;
dd) Effective measures for recalling non-conforming products and goods from the market are adopted.
VI. Method 6: Certification via assessing and supervising management system
Methods 6 is based on assessment of management system in order to certify conformity of management system to corresponding standards and technical regulations.
1. Details and procedures of primary activities in Method 6:
1.1. Assessing conformity of management system:
- Management system shall be assessed on the basis of corresponding standards and technical regulations.
- Filing reports on assessment results in relation to corresponding standards and technical regulations.
1.2. Certifying conformity:
Based on reports on conformity assessment and certification results of management system to corresponding standards and technical regulations.
Certificate of conformity of management system shall be valid for at most 5 years as long as management system undergoes supervision and assessment.
Governing ministries and certification bodies shall, on the basis of technical characteristics, level and stability of technology, scope and level of complexity in operation of management system, consider and decide specific effective period.
1.3. Supervising management system.
- Supervising via assessment of management system where assessment and supervision interval shall be at most 12 months or specific interval under corresponding standards and technical regulations.
- Supervision results shall serve as the basis to decide whether to maintain, temporarily suspend, or cancel conformity of management system.
2. Adoption principles of Method 6:
Method 6 is employed to assess conformity of processes, services, and environment with management system to corresponding standards and technical regulations.
VII. Method 7: Certification via testing, assessing shipment of product and goods
Method 7 is based on test results concerning samples of products and goods collected at random and at sufficient quantities to ensure representative nature of product and goods shipment in order to certify conformity of the shipment. Certification of conformity only applies to specific shipment; subsequent supervision measures shall not be required.
1. Details and procedures of primary activities in method 7:
1.1. Collecting samples:
Test samples are collected at random and representative of the entire shipment.
Quantity of samples must be sufficient for test and sample storage.
1.2. Assessing conformity of test samples
Proceed as detailed under 1.2 of Method 1.
1.3. Handling results:
Reviewing characteristics of products and goods via test results of samples in respect of corresponding standards and technical regulations.
1.4. Certifying conformity:
Product and goods shipment shall be considered conforming to regulations if the number of test samples with non-conforming results is within permissible limit.
Product and goods shipment shall be considered conforming to regulations if the number of test samples with non-conforming results is within permissible limit.
2. Adoption principles of Method 7:
Method 7 is adopted to certify conformity of products and goods under the following conditions:
a) Products and goods are classified into uniform shipments;
b) Requirements pertaining quality maintenance cannot be taken into consideration.
VIII. Method 8: Certification via testing or inspecting products and goods in their entirety
Method 8 is based on results of test or inspection of products and goods in their entirety in order to certify conformity prior to circulation, use, and operation. Certification of conformity only applies to individual product and goods; subsequent supervision measures shall not be required.
1. Details and procedures of primary activities in method 8:
1.1. Identifying products and goods to be tested or inspected;
1.2. Assessing conformity of products and products:
a) Test or inspection of products and goods shall be conducted by competent testing, inspecting bodies with registered operating fields at production, installation, use locations or at testing, inspecting bodies.
Accredited testing, inspecting bodies shall be recommended.
b) Characteristics of products and goods to be tested, inspected and test, inspection solutions shall be prescribed under corresponding standards and technical regulations.
1.3. Handling results:
Consider characteristics of products and goods via test or inspection results relative to requirements.
1.4. Certifying conformity:
Products and goods shall be considered conforming to standards and regulations if all criteria of tested or inspected products and goods conform to corresponding standards and technical regulations.
2. Adoption principles of Method 8:
