DECISION
ON PROMULGATION OF THE LIST OF PRODUCTS SUBJECT TO ENERGY EFFICIENCY TESTING AND ENERGY LABELING UNDER THE MANAGEMENT OF THE MINISTRY OF INDUSTRY AND TRADE
THE MINISTER OF INDUSTRY AND TRADE
Pursuant to the Law on Product and Goods Quality dated November 21, 2007;
Pursuant to the Law on Economical and Efficient Use of Energy dated June 17, 2010;
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to Decree No. 21/2011/NĐ-CP dated March 29, 2011 of the Government detailing and guiding the implementation of the Law on Economical and Efficient Use of Energy;
Pursuant to Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government defining the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of a number of articles of the Law on Product and Goods Quality, amended and supplemented by Decree No. 74/2018/NĐ-CP dated May 15, 2018 and Decree No. 154/2018/NĐ-CP dated November 9, 2018 of the Government;
Pursuant to Decree No. 85/2019/NĐ-CP dated November 14, 2019, regulating the implementation of administrative procedures under the national single-window and ASEAN single-window mechanisms and specialized inspection for export and import goods;
Pursuant to Decision No. 04/2017/QĐ-TTg dated March 9, 2017 of the Prime Minister on the list of vehicles and equipment subject to energy labeling, the application of minimum energy efficiency standards, and the implementation roadmap;
Pursuant to Decision No. 14/2023/QĐ-TTg dated May 24, 2023 of the Prime Minister on promulgating the list and roadmap of vehicles and equipment using energy that must be eliminated and power generation units with inefficient performance that are not allowed to be newly constructed;
Pursuant to Circular No. 36/2016/TT-BCT dated December 28, 2016 on energy labeling for vehicles and equipment using energy under the management scope of the Ministry of Industry and Trade;
Pursuant to Circular No. 31/2022/TT-BTC dated June 8, 2022 of the Ministry of Finance on the list of Vietnam’s export and import goods;
Pursuant to Decision No. 1182/QĐ-BCT dated May 20, 2019 of the Minister of Industry and Trade on promulgating the list of goods (with HS codes) subject to specialized inspection under the management of the Ministry of Industry and Trade;
At the request of the Director of the Department of Energy Efficiency and Sustainable Development.
DECISION:
Article 1. Promulgate the list of goods (with HS codes) subject to energy efficiency testing and energy labeling under the management of the Ministry of Industry and Trade as specified in the appendices attached to this Decision.
Article 2. Implementation organization:
Assign the Department of Energy Efficiency and Sustainable Development (i) to preside over and coordinate with relevant agencies and units to review, update, and publish the list of goods (with HS codes) subject to energy efficiency testing and energy labeling under the management of the Ministry of Industry and Trade in accordance with state management requirements from time to time; (ii) to promptly guide and address issues arising (if any) in the specialized inspection of the list specified in the appendices of this Decision.
Article 3. Implementation provisions:
1. This Decision takes effect from the date of its signing.
2. This Decision replaces Appendix III of Decision No. 1182/QĐ-BCT dated May 20, 2019 of the Minister of Industry and Trade on promulgating the list of goods (with HS codes) subject to specialized inspection under the management of the Ministry of Industry and Trade.
3. In case the legal documents referred to in this Decision are amended or supplemented, the provisions of the newly issued documents shall apply.
Article 4. The Chief of the Ministry Office, Directors of the Departments of Science and Technology, Energy Efficiency and Sustainable Development, Heads of units under the Ministry of Industry and Trade, and relevant organizations and individuals shall be responsible for implementing this Decision./.
