Vietnam MIC Circular No. 04/2023/TT-BTTTT on the new list of wireless and ICT products under MIC ICT Type Approval and Self-assessment DoC scope

EXTENDMAX - On May 31, 2023, Vietnam MIC has released Circular No. 04/2023/TT-BTTTT on the new list of wireless and ICT products under MIC ICT Type Approval and Self-assessment DoC scope. The circular 04/2023/TT-BTTTT shall replace the Circular No. 02/2022/TT-BTTTT and take effect from July 15, 2023 with significant updates on new QCVN test standards, new critical requirements for land mobile terminal devices, smart phones and several minor changes

1. Highlighted features and insights of the MIC circular 04/2023/TT-BTTTT:

1.1. MIC has updated new national technical standards (QCVN) to the list

(1) QCVN 18:2022/BTTTT (National technical regulation on electromagnetic compatibility for radio communication equipment) replaces QCVN 18:2014/BTTTT

(2) QCVN 130:2022/BTTTT (National technical regulation on electromagnetic compatibility of wireless audio equipment in the frequency range 25 MHz to 2000 MHz)

(3) QCVN 131:2022/BTTTT (National technical regulation on NB-IoT devices, LTE Cat M)

(4) QCVN 132:2022/BTTTT (National technical regulation on electrical safety for telecommunications and information technology terminal equipment)

Type Approval certificates and/or Declaration of Conformity listing the former version of QCVN standard (such as QCVN 65:2013/BTTTT, QCVN 18:2014/BTTTT) shal be automatically invalid from 15-July-2023

1.2. New critical requirements for land mobile terminal equipment and mobile phones

→ Terrestrial mobile communication terminals, imported or manufactured in Vietnam from July 01, 2024 for the first time, are required to integrate 4G LTE technology

→ The type approval certificate for terrestrial mobile communication terminals (isued before July 01, 2024), that do not integrate LTE technology, will automatically be invalidated on June 30, 2024.

→ 5G mobile communication terminals, imported or manufactured in Vietnam from July 15, 2023 for the first time, will be required to support both 5G SA and 5G NSA

→ The certificate of conformity for 5G mobile communication terminals (issued before July 15, 2023), that only lists one of the two standards QCVN 127:2021/BTTTT and QCVN 129:2021/BTTTT, will automatically be invalidated from 30/06/2024.

1.3. Update HS codes of goods according to Circular No. 31/2022/TT-BTC

The list of products and goods of group 2 has been updated with HS codes and descriptions of goods according to the contents of Decision No. 2125/QD-BTTTT dated November 21, 2022 of the Ministry of Information and Communications on the adjustment of some HS codes on the List of potentially unsafe products. In this circular 04/2023/TT-BTTTT, new HS codes (or changed HS codes) are included in the list for convenience in searching and applying. New products (new HS codes) shall be fallen under mandatory scope.

1.4. Some other small adjustments to the list of products and goods of group 2

  • Additional notes applicable to QCVN 47:2015/BTTTT; QCVN 132: 2022/BTTTT.
  • Changed electrical safety standards applicable to DECT phones from QCVN 22:2010/BTTTT & QCVN 22:2021/BTTTT to apply QCVN 132:2022/BTTTT.
  • The list of products of group 2 adds the E-UTRA narrowband IoT terminal at section 1.1.11 (applying the newly issued QCVN 131:2022/BTTTT), and the personal FM radio device is removed (equipment not imported for many years).
  • NFC moved from Annex 1 to Annex 2 (was proposed in the draft version of this circular). It means now NFC is not under Type Approval certification scheme, but under SDoC scheme only

1.5. Taking effect date of the circular 04/2023/TT-BTTTT on the list of group 2 products and goods

The circular 04/2023/TT-BTTTT shall take effect and replace Circular No. 02/2022/TT-BTTTT from July 15, 2023.

2. ExtendMax's recommendation regarding the circular 04/2023/TT-BTTTT:

a) Regarding implementation of the QCVN 132:2022/BTTTT

  • Particularly for DECT phones, QCVN 132:2022/BTTTT is listed in Appendix 1 and marked with a (***) remark, this means that QCVN 132:2022/BTTTT is the applicable standard for Type Approval certification scheme. Therefore, DECT phones that have been certified for conformity according to QCVN 22:2010/BTTTT and/or QCVN 22:2021/BTTTT will have to undergo re-certification procedures according to IEC62368-1:2018 for period from 15-July-2023 till 31-Dec-2023, and re-certified again with QCVN 132:2022/BTTTT from 01-Jan-2024 to continue being imported to Vietnam.
  • For other products such as laptops, desktop computers, TVs, tablets, Set-top-boxes... QCVN 132:2022/BTTTT is confirmed as the standard under self-assessment of declaration of conformity (SDoC) issued by enterprises (not the applicable standard for certification of conformity). Therefore, the application of QCVN 132:2022/BTTTT does not affect the certificates of conformity issued before January 1, 2024 for products within the scope of application of QCVN 132:2022/BTTTT.
  • The MIC temporary accept test report issued by oversea and local ISO/IEC 17025 accredited test laboratories according to IEC 62368-1:2018, with corresponding technical requirements, for conformity assessment according to the QCVN 132:2022/BTTTT. It means the IEC 62368-1:2018 must listed all applicable test cases of the QCVN 132:2022/BTTTT still in order to be accepted by the VNTA. Accordingly, applicants and importers must submit ISO/IEC 17025 certificate of test lab which is still valid, together with Type Approval and/or Declaration of Conformity application.

b) Recommendations on the application of QCVN 127:2021/BTTTT and QCVN 129:2021/BTTTT

Because domestic testing laboratories are still not qualified to test QCVN 127:2021/BTTTT and QCVN 129:2021/BTTTT for 5G NR phones and terminals, it is expected that the Ministry of Information and Communications will continue to allow using test reports issued by domestic and foreign laboratories certified with ISO/IEC 17025 for ICT conformity certification process.

In the past period, importers faced many difficulties in getting 5G NR phones certified mainly because foreign test results according to ETSI EN were exempted from some test cases under CE rules, but these test cases are still required by the VNTA to certify conformity according to QCVN 127:2021/BTTTT and QCVN 129:2029/BTTTT. This is a requirement that has arisen in the past period, not a new requirement, but it is the requirement that many manufacturers or importing companies find it most difficult to meet due to the very high cost of 5G NR testing. In order to a smooth certification of conformity process, manufacturers and importing companies should actively test the full range of ETSI criteria, including those exempted from CE RED regulations.

c) Regarding other wireless product operate in frequency bands higher than 40GHz

Beside the  QCVN 127:2021/BTTTT and QCVN 129:2021/BTTTT, MIC will also allows test report issued by ISO/IEC 17025 test laboratory for RF standards for products having operating frequency over 40GHz such as QCVN 123:2021/BTTTT, QCVN 124:2021/BTTTT. This will be specified by a MIC guidance letter which shall be issued on around Jun 15, 2023 and similar like the MIC letter No. 2361/BTTTT-KHCN.

d) Other confusion within the Circular 02/2022/TT-BTTTT

→ MIC states that maritime radar is exempt from "Product Quality Inspection" for imported products but organizations or individuals still have to make self-assessment Declaration of Conformity before use. However, Pursuant to Decree 132/2008/ND-CP (amended and supplemented by the Decree 74/2018/ND-CP) SDoC is a part of the "Product Quality Inspection" process. MIC has not yet released guidance for applying for SDoC for maritime radar without applying for PQIR.

e) Other MIC QCVN technical regulations released recently

Other MIC technical regulations which draft version has been released recently like QCVN 117:2023/BTTTT and QCVN 55:2023/BTTTT shall be included in list of product under TAC and SDoC 2024~2025 period.

Regulations on List of products and goods liable to cause unsafety under the governance of the Ministry of Information and Communications

Pursuant to the Law on quality of products and goods dated November 21th, 2007;

 

Pursuant to the Law on Telecommunications dated November 23rd, 2009;

 

Pursuant to the Law on Radio Frequency dated November 23rd, 2009; Law amending and supplementing a number of articles of Law on Radio Frequency dated November 9, 2022;

Pursuant to the Law on Information Technology dated June 29th, 2006;

 

Pursuant to Decree No. 132/2008/ND-CP dated December 31st, 2008 promulgated by the Government on detailing the implementation of some articles of the Law on quality of products and goods, Decree No. 74/2018/ND-CP dated March 05th, 2018 promulgated by the Government on amending and supplementing some articles of Decree 132/2008/ND-CP promulgated by the Government on stipulating in detail the implementation of some articles of   Law on quality of products and goods;

 

Pursuant to Decree No. 13/2022/ND-CP dated January 21st, 2022 amending and supplementing some articles of Decree 132/2008/ND-CP dated December 31st, 2008 and Decree No. 74/2018/ND-CP dated March 05th, 2018 promulgated by the Government on stipulating in detail the implementation of some articles of   Law on quality of products and goods and Decree No. 86/2012/ND-CP dated October 19th, 2012 of the Government promulgates a number of articles of Law on Measurement.

 

Pursuant to Decree No. 48/2022/ND-CP dated July 26th, 2022 promulgated by the Government regulating the functions, tasks, authority and organizational structure of the Ministry of Information and Communications;

 

Pursuant to the proposal of Director General of Department of Science and Technology,

 

The Minister of Information and Communications issues the Circular prescribing Regulations on list of products and goods potentially cause unsafety under the governance of the Ministry of Information and Communications.

 

Article 1. Scope of application

 

1. This Circular specifies list of products and goods potentially causing unsafety under the governance of the Ministry of Information and Communications (hereinafter referred to as the “List of products and goods in group 2”) and principle to manage products and goods in group 2

2. This Circular applies only to products and goods having HS code and descriptions specified in List of products and goods in Group 2.

 

Article 2. Subjects of application

This Circular is applied to:

1.  Organizations and individuals engage in production and business of products and goods in List of products and goods in group 2 in Vietnam.

2. Organizations and individuals engage in managing the quality of products and goods in List of products and goods in group 2 in Vietnam.

 

Article 3. List of products and goods in group 2.

1. The list of products and goods in group 2 and forms of management are defined as follows:

a) "The list of products and goods in information technology and telecommunication requiring mandatory Type Approval certification and Declaration of Conformity” is stipulated in Annex I of this Circular.

b) "The list of products and goods in information technology and telecommunication requiring mandatory Declaration of Conformity” are stipulated in Annex II of this Circular.

2. In each period, the Ministry of Information and Communications shall consider amending and adjusting the list of products and goods in group 2 to be consistence with State management policies.

 

Article 4. Management Principles

1.  The management of products and goods in group 2 is implemented pursuant to the regulations issued by the Ministry of Information and Communications on Type Approval certification, Declaration of Conformity and the product quality inspection for products, goods in information technology and telecommunication industries and according to national technical regulations.

2. Products and goods in group 2 that integrates the functionality of other products and goods in group 2 must be certified with type approval certification, declaration of conformity according to national technical regulations applied to products and goods which are integrated.

3. Products and goods in group 2 that is applicable subject of two or more national technical regulations, is required to conduct Type Approval certification and Declaration of Conformity in accordance with all the respective national technical regulations.

4. In case there are national technical regulations issued before enforcement date of this Circular, which regulates Type Approval certification and Declaration of Conformity differently with regulation of this Circular, this Circular must be prevailed.

5. In case there are national technical standard newly issued to amend, or replace, or renewed national technical regulations applied for products and goods in List of products and goods in group 2, the new national standards shall automatically take effect.

 

Article 5. Provisions of implementation

1.  This Circular shall take effect from July 15, 2023.

2. The Circular No. 02/2022/TT-BTTTT dated May 16, 2022 issued by the Minister of Information and Communications on Regulations on list of products and good potentially unsafe under the governance of the Ministry of Information shall be expired from taking effect date of this circular.

3.  Type approval certificates, Letters of notification for acceptance of declaration of conformity which have been issued before the enforcement date of this Circular, which are not expired yet, shall keep its validity continuously until new national technical regulations come into force to replace the national technical regulations listed on Type approval certificates, Letters of notification for acceptance of declaration of conformity.

 

Article 6. Provisions of implementation

1. Chief of MIC Office, General Director of Department of Science, Directors of other departments of MIC, Heads of agencies and authorities under the Ministry of Information   and Communications, related organizations and individuals shall be responsible for the implementation this Circular. / .

2. During the implementation period of national technical regulations, standards, and local testing, individual and organization shall report the issue and follow official guidance of Ministry of Information and Communications (particularly Department of Science and Technology).

4. In case issue arising out of determining HS codes of imported goods which likely cause unsafety under the regulating of this Circular, the Ministry of Information and Communication shall coordinate with the Ministry of Finance (General Department of Customs) to settle.

Type Approval Certificate for terminal equipment Terrestrial mobile communication terminal, which is not a mobile phone, that only integrates/uses W-CDMA FDD (3G), GSM (2G and 2.5G) technology according to QCVN 117:2020/BTTTT shall still be valid and continue to be applied until expiry date, but not later than June 30, 2024.

e) The certificate of conformity for the fifth generation (5G) mobile communication terminal equipment only in accordance with one of two technical regulations QCVN 127:2021/BTTTT or QCVN 129:2021/BTTTT shall still be valid and continue to be applied until expiry date, but not later than June 30, 2024.

Declaration of conformity is only made when the equipment is suitable in terms of frequency band and technical and operational conditions as prescribed.
