Summary of changes in procedures for certification of conformity of radio transceiver equipment in 2023 and forecast of applicable regulations and effects of new regulations in 2024

2023 is the year when the Ministry of Information and Communications and the Vietnam Telecommunications Authority (VNTA) applied many changes in regulation conformity certification procedures, including changes in requirements for regulation conformity certification documents according to method 1 - testing. typical samples, requirements for testing under extreme conditions (also known as critical conditions)... Changes are applied continuously in a short period of time, so most of importers have difficulty adapting response. Let's review the main changes below

Summary of changes in 2023

  • In early May 2023, the Telecommunications Quality Measurement Center of VNTA (TQC) applied a number of changes in the conformity certification process. Accordingly, in cases of hiring a third-party processing factory (factory with ISO 9001 certificate), oversea manufacturer must have a official representative officer or branch company in Vietnam to authenticate the documents, or the VNTA request to inspect actual production at the processing factory.
  • On May 31, 2023, the Vietnam MIC issued Circular No. 04/2023/TT-BTTTT stipulating the list of products requiring certification and declaration of conformity to replace Circular 02/2022/TT-BTTTT on May 31, 2023. July 15, 2023
  • After issuing Circular No. 04/2023/TT-BTTTT, the Vietnam MIC did not issue official documents guiding application as usual. Regulation conformity certification organizations and businesses encounter many confusions and difficulties in certifying conformity, including critical conditions according to Circular No. 04/2023/TT-BTTTT and corresponding technical regulations
  • On September 5, 2023, the Vietnam MIC issued Circular No. 10/2023/TT-BTTTT, temporarily suspending the effect of a number of technical regulations and testing requirements in harsh conditions because domestic testing laboratories have not meet the conditions
  • On September 15, 2023, the Vietnam MIC organized a workshop to guide businesses in implementing Circular No. 04/2023/TT-BTTTT and Circular No. 10/2023/TT-BTTTT. During the workshop, businesses asked about using foreign testing results to replace QCVN 132:2022/BTTTT testing as prescribed in QCVN 132:2022/BTTTT. At a subsequent seminar, representatives of the Vietnam MIC instructed businesses to test QCVN 132:2022/BTTTT at a testing laboratory designated by the Vietnam MIC (domestic testing laboratory) or a foreign testing laboratory recognized under the MRA
  • On late of 2023 VNTA made certain changed regarding implementation including:

- Not accept TA cert under name of Vietnam Rep. Office or Branch of manufacturer to be leveraged by other importers. Only TAC under name of oversea manufacturer can be accepted

- Request oversea manufacturer to send hard copies of LOA and SDoC together with sending the documents via emails to VNTA email directly for authorizing other importers using their TA certificate or SDoC. This is a long and paintful process.

  • On November 27, 2023, the Vietnam MIC issued a draft circular amending Circular No. 04/2023/TT-BTTTT regulating the list of products requiring certification and declaration of conformity. The draft content has adjusted a number of applicable standards to suit the actual testing situation in the country

 

Forecast of changes in 2024 and impacts

  • Due to the huge demand for testing according to QCVN 132:2022/BTTTT, it is expected that the testing situation will continue to be difficult until April or May 2024.
  • 5G NR mobile phones are required to operate in at least 6 bands n1, n3, n28, n41, n77, n78 from January 7, 2024.
  • The Circular amending Circular No. 04/2023/TT-BTTTT is expected to take effect from April 1, 2024 along with some positive changes in the application of standards and regulations.
  • WWAN terminal devices (other than phones) are required to support LTE from July 1, 2024
  • Wireless charging devices do not have to apply QCVN 55:2023/BTTTT from July 1, 2024
  • Stop taking effect of QCVN 123:2021/BTTTT, QCVN 124:2021/BTTTT, and continue to stop taking effect of a number of technical regulations that have not been tested domestically from July 1, 2024
  • QCVN 55:2023/BTTTT and QCVN 117:2023/BTTTT (along with a number of other standards) shall be enforced from July 1, 2004. Mobile phone, GPS tracker, WWAN terminal and NFC device shall need to re-apply for MIC Type Approval / SDoC according to new standardsQCVN 55:2023/BTTTT and QCVN 117:2024/BTTTT. Testing of QCVN 55:2023/BTTTT and QCVN 117:2024/BTTTT is expected to start in May or June 2024 in conditions where there are still many limitations in testing capacity.
