On May 31, 2025, the Ministry of Science and Technology issued Circular No. 04/2025/TT-BKHCN, amending and supplementing certain provisions of Circular No. 28/2012/TT-BKHCN. The key amendment concerns the decentralization of authority for receiving declarations of conformity, which is now delegated more broadly to local specialized departments.
Previously, declarations of conformity for household goods were submitted to local Sub-Departments of Standards, Metrology, and Quality, while declarations for ICT products were submitted to the Authority of Telecommunications. According to the new regulation, the declaration of conformity must now be submitted to the Department of Science and Technology in the locality where the enterprise is registered.

CIRCULAR
AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 28/2012/TT-BKHCN DATED DECEMBER 12, 2012 OF THE MINISTER OF SCIENCE AND TECHNOLOGY REGULATING THE ANNOUNCEMENT OF STANDARD CONFORMITY, ANNOUNCEMENT OF TECHNICAL-REGULATION CONFORMITY AND METHODS OF ASSESSING CONFORMITY WITH AMENDED STANDARDS AND TECHNICAL REGULATIONS, SUPPLEMENTED BY CIRCULAR NO. 02/2017/TT-BKHCN DATED MARCH 31, 2017
Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to the Government's Decree No. 127/2007/ND-CP dated August 1, 2007 detailing the implementation of a number of articles of the Law on Standards and Technical Regulations;
Pursuant to the Government's Decree No. 55/2025/ND-CP dated March 2, 2025 defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;
At the proposal of the Chairman of the National Committee for Standards, Metrology and Quality;
The Minister of Science and Technology promulgates the Circular amending and supplementing a number of articles of the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology regulating the announcement of standard conformity, announcement of technical-regulation conformity and methods of assessment of conformity with standards, technical regulations are amended and supplemented by Circular No. 02/2017/TT-BKHCN dated March 31, 2017.
Article 1. Amending and supplementing a number of articles of the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology regulating the announcement of standard conformity, announcement of technical-regulation conformity and methods of assessment of conformity with amended standards and technical regulations, supplemented by Circular No. 02/2017/TT-BKHCN dated March 31, 2017
1. Clause 5 of Article 12 is amended as follows:
"5. In case products and goods are managed by different technical regulations, organizations and individuals announcing technical-regulation conformity must register the technical-regulation conformity announcement at the corresponding competent state agency as prescribed in Clause 2, Article 48 of the Law on Standards and Technical Regulations, include:
a) Specialized departments as prescribed in Clause 2, Article 14 of the Government's Decree No. 127/2007/ND-CP of August 1, 2007 detailing the implementation of a number of articles of the Law on Standards and Technical Regulations;
b) In case there is no specialized department, the agency attached to the ministry or ministerial-level agency managing the branch or field shall be appointed or assigned the responsibility to receive the dossier of declaration of technical-regulation conformity of the organization or individual. The agencies specified at Points a and b of this Clause are hereinafter referred to as specialized agencies.
The conformity mark is only used when such products and goods have fully implemented management measures as prescribed in the corresponding technical regulations.".
2. The first paragraph of Article 14 is amended as follows:
"Organizations and individuals announcing technical-regulation conformity shall make dossiers of declaration of technical-regulation conformity and submit them directly or online on the online public service portal or send dossiers by post to specialized agencies. The composition of the dossier is prescribed as follows:"
Article 2. Responsibilities for organizing the implementation
Ministers, heads of ministerial-level agencies, heads of government-attached agencies, presidents of provincial-level People's Committees and relevant organizations and individuals shall be responsible for the implementation of this Circular.
Article 3. Enforcement Terms
1. This Circular takes effect from July 15, 2025.
2. In the course of implementation, if there are difficulties or problems, agencies, organizations and individuals are requested to report in writing to the Ministry of Science and Technology for guidance or study, amendment and supplementation accordingly./.
