VNTA stopped issuing ADoC for imported products, guides applicants to make SDoC

VNTA has stopped accepting DoC applications for imported products since 10 August 2018 without official notice. Instead, VNTA guides importers and applicant to make Self-assessment Declaration of Conformity.

EXTENDMAX - Since 10 August 2018, VNTA has stopped receiving ADoC application (for imported products) without official warning or notice. This issued has been raised because of the conflict between MIC Circular 30/2011/TT-BTTTT and Government Decree 74/2018/ND-CP. Pursuant to the Decree 74/2018/ND-CP, the Declaration of Conformity form (self-assessment) prepared by the importer / applicant is required to be submitted to VNTA to finish the "imported product quality inspection" process. This means ADoC certificates (Acceptance of Declaration of Conformity) issued by VNTA so far does not play a role in customs clearance process and importer can find no use of. In practice, ADoC certificate has been rejected by customs officer because it is not in compliance with Decree 74/2018/ND-CP. This embarrassing situation could be the reason why VNTA decides to stop issuing ADoC certificate.

The application submited to VNNT before 10 August 2018 will still be processed and the last ADoC certificates issued by VNTA would be dated on around 18 August 2018. This will be applicable for product listed under both Appendix I and Appendix II of Circular 04/2018/TT-BTTTT of MIC Vietnam. The above implementation obviously violates Declaration of Conformity procedures regulated by Circular 30/2011/TT-BTTTT of MIC Vietnam so in order to make the MIC regulation in compliance with Decree 74/2018/ND-CP, MIC must revise the Circular 30/2011/TT-BTTTT accordingly.
