Declaration of Conformity (DoC) for wireless and ITE ICT products in-depth guides

EXTENDMAX  Pursuant to regulations of Ministry of Information and Communications Vietnam  (MIC Vietnam) at Circular to regulated products and goods under group 2 which requiring mandatory conformity certification and declaration of conformity (at this moment it is Circular 04/2023/TT-BTTTT), all the product listed on Appendix 1 and Appendix 2 of such Circular need MIC Vietnam Declaration of Conformity certification and ICT Mark labeling before entering Vietnam markets (importer sells the product to any third party or end-users).

1.   Applicable regulations

Circular 30/2011/TT-BTTTT of MIC Vietnam – Regulations on Type Approval (TA) certification and Declaration of Conformity (DoC) certification for Information and Communication Technology (ICT) products (including its amendment and supplement versions).

Circular 04/2023/TT-BTTTT of MIC Vietnam – Regulations on list of products subjected to mandatory TA certification and DoC certification:

   + Appendix 1 of Circular 04/2023/TT-BTTTT: List of radio / ICT products subjected to both mandatory MIC Type Approval certification and mandatory MIC Declaration of Conformity certification.

   + Appendix 2 of Circular 04/2023/TT-BTTTT: List of radio / ICT products subjected to MIC Declaration of Conformity certification only

2.   Declaration of Conformity certification procedures and requirements

Procedures and documents required for Declaration of Conformity certification for products listed on Appendix 1 of the mentioned Circulars are different from product listed on Appendix 2.

A branch of "Telecom Metrology and Quality Center" - subsidiary of the Vietnam Telecommunications Authority (VNTA) shall review the application dossier. If the products are imported products, then after VNTA accept DoC dossier, the process shall be completed. If the products are domestic manufactured product, VNTA shall issue official notification for Acceptance of Declaration of Conformity (ADoC)  if the application complies with MIC Vietnam regulations.

2.1   Procedures and requirement for Declaration of Conformity process

Dossier for imported goods and products

→ Product specifications sheet or product data sheet

→ Self-assessment report (aka self-delcaration of conformity) according to QCVN

Product Quality Inspection Registration (PQIR) form (acknowledged by VNTA)

→ A copy of type approval certificate of product (for products listed under Appendix 1)

→ Test reports for applicable national technical standards applied to the products.

→ A copy of Enterprise Registration Certificate (ERC) of applicant

ICT Mark of DoC applicant (local importer)

Dossier for domestic manufactured products:

→ Declaration of Conformity form (for domestic manufactured product)

→ Product specifications sheet or product data sheet

→ Self-assessment report (aka self-declaration of conformity) according to QCVN

A copy of type approval certificate of product (for products listed under Appendix 1)

→ Test reports for applicable national technical standards applied to the products.

→ A copy of Enterprise Registration Certificate (ERC) of applicant

ICT Mark of DoC applicant (local manufacturer)

Applicant submit DoC application dossier to a branch of Telecom Metrology and Quality Center of the VNTA.

For domestic manufactured products: The Telecom Metrology and Quality Center shall review the documents and submit to VNTA for issuing official letter of Acceptance for Declaration of Conformity (ADoC) if the application dossier complies with regulations of MIC Vietnam / VNTA.

For imported products: Declaration of Conformity process is completed via "Product Quality Inspection" procedure. The process is completed once the Telecom Metrology and Quality Center receive the dossier without any additional requests. Official letter of Acceptance for Declaration of Conformity (ADoC) is no longer issued for imported products since 2018

 

3.   Frequently asked questions related to Declaration of Conformity

Q: What is the Declaration of Conformity? What is Authority in charge?

A: Declaration of Conformity is a process in which manufacturers or importers announce that their products are complied with relevant Vietnam national technical regulations and standards.  The Viet Nam Telecommunication Authority (VNTA) verifies application dossiers.

 

Q: We have obtained Type approval certificates for our products, why do we still need DoC? 

A: Pursuant to Circular 04/2023/TT-BTTTT , all products listed on Appendix 1 required both Type approval certification and Declaration of Conformity certification.

 

Q: We are oversea manufacturer, do we need to apply for Declaration of Conformity? 

A: Oversea manufacturer is not the applicant for Declaration of Conformity process, unless you are also importer. However, because the testing could be complete, you should send samples to Vietnam for testing before exporting to ensure a smooth customs clearance.

 

Q: Our product is a desktop computer listed on Appendix 2 of the mentioned Circular, why do we to apply for both TAC and DoC instead of DoC only?

A: Desktop computer with wireless interfaces like Wifi 802.11 a/b/g/n/ac or NFC or other (wireless connection interface) is considered as radio product listed on Appendix 1 and subjected to both Type approval certification and Declaration of Conformity certification.

 

Q: Is there a validity period of MIC / VNTA DoC acceptance letter for domestic manufactured products?

A: ADoC has maximum 03 year validity period or bound to validity period of Type Approval certificate. You have to renew ADoC only when national technical regulations (QCVN and TCVN) related to product updated.
