EXTENDMAX - On June 8, 2022, the Ministry of Finance issued Circular 31/2022/TT-BTTTT stipulating the list of Vietnam's exports and imports with HS codes with adjustments based on the Harmonized System code (HS code) of the World Customs Organization. In order to ensure the validity of the List of civil cryptographic products exported and imported under license (attached to Decree No. 53/2018/ND-CP), the Government Cipher Committee prepares a draft Decree amending and supplementing the Decree 53/2018/ND-CP and the Decree No. 58/2016/ND-CP detailing the list civil cryptographic products export and import under license. The draft version has been issued as Decree 32/2023/ND-CP, taking effect from July 09, 2023
The main purpose of building the Decree 32/2023/ND-CP, amending and amending and supplementing the Decree 53/2018/ND-CP and the Decree 58/2016/ND-CP, is to convert HS codes in the List of civil cryptographic products export and import according under license issued together with the Decree 53/2018/ND-CP. Accordingly, the list of civil cryptographic products imported and exported under the civil cryptography license shall be updated with the corresponding HS codes prescribed by Circular 31/2022/TT-BTC of the Ministry of Finance.
The biggest change in the list of civil cryptographic products belongs to the product group with HS code 8517.70, details are as follows:

Pursuant to the Law on Government Organization dated June 19, 2015; Law dated November 22, 2019 on Amendments to some Articles of the Law on Government Organization and Law on Local Government Organization;
Pursuant to the Law on Cyberinformation Security dated November 19, 2015;
At the request of the Minister of National Defense;
The Government hereby promulgates a Decree on amendments to the Government’s Decree No. 53/2018/ND-CP dated April 16, 2018 on amendments to the Government’s Decree No. 58/2016/ND-CP dated July 01, 2016 elaborating on trading of civil cryptography products and services, and export and import of civil cryptography products.

The Appendix II - List of civil cryptography products exported and imported under license enclosed with the Government’s Decree No. 58/2016/ND-CP dated April 16, 2018 is replaced with the Appendix - List of civil cryptography products exported and imported under license enclosed with this Decree.
1. This Decree comes into force from the date on which it is signed.
2. Any license to export/import civil cryptography product before the effective date of this Decree shall remain valid for completion of customs procedures until its expiry date if name of such product matches the corresponding description of goods in Vietnam’s Nomenclature of exports and imports. The customs authority shall rely on Vietnam’s Nomenclature of exports and imports, issued license to export/import civil cryptography product and actual status of the exports/imports to assign HS codes and initiate customs clearance procedures in accordance with regulations.
Article 3. Responsibility for implementation
Ministers, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People's Committees of provinces and central-affiliated cities, relevant organizations and individuals are responsible for the implementation of this Decree./.
