EXTENDMAX - Following our article on draft version of the new Prime Minister's Decision on promulgating the list and roadmap of energy-using vehicles and equipment that must be eliminated and low energy efficiency electric generator sets not allowed to be built in order to eliminate the low energy efficiency equipment, the Prime Minister has signed official version Decision No. 14/2023/QD-TTg dated May 24, 2023 with few changes. Accordingly, many new products has been included in the list and must meet minimum energy efficiency such as induction hops, infrared hops, and desktop computers. Many products will have to apply a higher level of minimum energy performance standard (MEPS), apply for energy efficiency DoC and EE labelling according to the new version of TCVN 2021 such as television sets (TVs), ductless air conditioners, laptops. The Vietnam MOIT shall release a guidance for voluntary application before enforcement date, so the manufacturers and importers can apply the new standards in advance, instead of older version.

Specifically, the decision does not allow the import, manufacture and sale of energy-efficient equipment that does not meet the minimum energy efficiency levels specified in the respective National Technical Standards (TCVN) as follows:

DECISION

LISTS OF LOW-EFFICIENCY EQUIPMENT SUBJECT TO ELIMINATION AND LOW-EFFICIENCY GENERATING SETS BANNED FROM DEVELOPMENT AND APPLICATION ROADMAPS

Pursuant to the Law on Organization of the Government of Vietnam dated June 19, 2015; the Law on Amendments to the Law on Organization of the Government of Vietnam and the Law on Organization of the Local Government of Vietnam dated November 22, 2019;

Pursuant to the Law on Economical and Efficient Use of Energy dated June 28, 2010;

Pursuant to Decree No. 21/2011/ND-CP dated March 29, 2011 of the Government of Vietnam elaborating on measures to implement the Law on Economical and Efficient Use of Energy;

At the request of the Minister of Science and Technology of Vietnam;

The Prime Minister of Vietnam hereby promulgates the Decision on lists of low-efficiency equipment subject to elimination and low-efficiency generating sets banned from development and application roadmaps.

Article 1. Scope

1. This Decision provides for lists of low-efficiency equipment subject to elimination (banned from import and domestic manufacturing and sale) and low-efficiency generating sets banned from development and application roadmaps.

2. This Decision does not apply to equipment subject to temporary import, re-export, and purposes of repairing, replacing, and inspecting energy efficiency.

Article 2. Regulated entities

This Decision applies to state agencies, enterprises, organizations, and individuals importing, manufacturing, and trading goods prescribed in Article 3 hereof.

Article 3. Lists of low-efficiency equipment subject to elimination and low-efficiency generating sets banned from development and application roadmaps

1. The list of low-efficiency equipment subject to elimination (with application roadmaps) in Appendix I enclosed hereof includes:

a) Home appliances: Compact fluorescent lamps, electronic ballasts for fluorescent lamps, electromagnetic ballasts for fluorescent lamps, linear tubular fluorescent lamps, storage water heaters, infrared hobs, induction hubs, LED lamps, non-ducted air conditioners, clothes washing machines for household use, television sets, electric cookers, electric fans, refrigerators, refrigerator-freezers, and freezers.

b) Office and commercial equipment: Computer monitors, copiers, printers, notebook computers, desktop computers, and commercial refrigerated cabinets.

c) Industrial equipment: Three-phase asynchronous squirrel cage electrical motors, distribution transformers, LED road and street lighting luminaires, and industrial boilers.

2. Regulations on Appendix II enclosed hereof on the list of low-efficiency coal-fired and gas-fired generating sets in thermal power plants banned from development and its specific application roadmap are as follows:

a) It is prohibited to approve guidelines for investment in any coal-fired or gas-fired generating set whose efficiency fails to satisfy the minimum energy standards in Appendix II enclosed hereof.

b) It is prohibited to operate any coal-fired or gas-fired generating set whose efficiency fails to satisfy the minimum energy standards in Appendix II, enclosed hereof, at the time of commercial operation.

Article 4. Implementation

1. The Ministry of Science and Technology of Vietnam shall:

a) Take charge and cooperate with ministries, ministerial agencies, governmental agencies, and People’s Committees of provinces and centrally affiliated cities in implementing measures to phase out low-efficiency equipment subject to elimination and low-efficiency generating sets banned from development prescribed in this Decision.

b) Take charge and cooperate with relevant ministries and central authorities in developing national standards on energy efficiency and minimum energy efficiency of equipment.

c) Take charge and cooperate with ministries, based on socio-economic development situation and state management requirements during the implementation, in managing sectors and fields and presenting decisions on amendments to or replacements for lists of low-efficiency equipment subject to elimination and low-efficiency generating sets banned from development to the Prime Minister of Vietnam

2. The Ministry of Industry and Trade of Vietnam shall:

a) Take charge and cooperate with the Ministry of Science and Technology in inspecting compliance with regulations on the elimination of low-efficiency equipment and low-efficiency generating sets banned from development prescribed hereof.

b) Take charge and cooperate with relevant ministries and central authorities in guiding and inspecting the import and export of goods in compliance with regulations on the elimination of low-efficiency equipment subject to elimination and low-efficiency generating sets banned from development prescribed hereof.

c) Cooperate with the Ministry of Science and Technology of Vietnam in developing and reviewing national standards on energy efficiency and minimum energy efficiency of equipment.

3. Ministries and central and local authorities shall, based on their functions, tasks, and entitlements, take charge of the elimination of low-efficiency equipment and low-efficiency generating sets banned from development.

Article 5. Implementation provisions

1. This Decision comes into force as of July 15, 2023.

Decision No. 24/2018/QD-TTg dated May 18, 2018 of the Prime Minister of Vietnam on lists of low-efficiency equipment subject to elimination and low-efficiency generating sets banned from development and application roadmaps shall expire from the effective date of this Decision.

2. Ministers, heads of ministerial agencies, heads of governmental agencies, Chairpersons of People's Committees of provinces and centrally affiliated cities, heads of relevant agencies, units, organizations, and relevant individuals shall implement this Decision.
