Vietnam MIC: Circular 08/2021/TT-BTTTT - List of equipment exempt from frequency license


The Vietnam Ministry of Information and Communications has issued Circular No. 08/2021/TT-BTTTT signed on October 14, 2021 stipulating the list of radio equipment exempt from radio frequency license, technical and operational conditions. This Circular has many new points with an open mind in comparision to the old version, Circular No. 46/2016/TT-BTTTT.

Previously, organizations and individuals were only allowed to import products that pre-fixed default software to meet technical and operational conditions which are mostly in operating frequency range and transmit power (according to Clause 3, Article 4 of Circular No. 46/2016/TT-BTTTT). This requirement has caused confusion for enterprises when importing international version products which has frequency range and transmit power range larger than permitted value in Circular No. 46/2016/TT-BTTTT (amended and supplemented by Circular No. 18/2018/TT-BTTTT). While many organization can adjust the product to meet the specified frequency bands transmit power levels before use, the products which has frequency range and transmit power range larger than permitted value is still not "allowed for import". According to the new view in Circular No. 08/2021/TT-BTTTT, the content related to import has been eliminated, products that meet the technical and operational conditions will be allowed to be used (and certified for conformity). This means that enterprises can import international version products which has frequency range and transmit power range larger than permitted value in Circular No. 08/2021/TT-BTTTT first, and then use technical solutions to adjust the products to the pre-specified level before testing, certifying conformity, and using. Along with that, enterprises are fully responsible before the law for the use of products that must conform to the technical and oprational conditions specified in the Circular No. 08/2021/TT-BTTTT.

Highlight on new changes of Circular 08/2021/TT-BTTTT:

1. Now the products which does not meet the Circular No. 08/2021/TT-BTTT can be imported first, then be adjusted to satisfy the requirements before applying for in-country test, type approval, or use

2. Remove definition of “Wide band communication devices” and its corresponding appendix (Appendix 13 at former circular)

3. Radio Locan Area Network - RLAN equipment has been added to group of "Wireless Local Area Network" equipment

4. Low-Power Wide Area Network - LPWAN equipment has been added together with its corresponding Appendix.

5. New appendix for wireless power transfer devices, hearing aids has been moved to inductive loop device section

6. 2400MHz ~ 2483.5MHz and 5725MHz ~ 5850MHz ISM bands can be used for remote control devices

7. MIC allocates several additional bands for short range radar used inside storage tank.

8. MIC allocates one more range for UWB device which is 7238.4 ~ 9000MHz (beside 4000 ~ 4800 Mhz band at this moment)

The new MIC Circular No. 08/2021/TT-BTTTT shall enter inforce from November 28, 2021 and replace Circular 46/2016/TT-BTTTT and Circular 18/2018/TT-BTTTT.

In general, Circular No. 08/2021/TT-BTTTT is built on an open mind. However, there are a number of products for search and rescue purpose listed in Appendix 20 "must not be used for other purposes not yet permitted by law". This point can be confusing in implementation and can be better improved by the point of view "enterprises are allowed to use for purposes not prohibited by law".

Unfortunately, WiFi 6E (6GHz) is not allowed yet.
