Vietnam: How regulations on Lithium Battery certification are implemented in practice

EXTENDMAXDoC Certification for Lithium Battery (used for portable applications – cell phones, tablets, and laptop, note book personal computers) has been forced by MIC Vietnam since 01– Oct – 2017 but implementation is a bit different in each Verification and Certification Center of VNTA Vietnam. The major difference is how applicants obtain Signed Declaration of Conformity – SDoC certificate (also known as Notification of Acceptance of Declaration of Conformity – ADoC certificate, or Letter of Notification of Acceptance of Declaration of Conformity – LoNA certificate) for the end-products (cell phones, tablets, and laptop, notebook PC).

 

1. Overall implementations:

- At current stage, MIC Vietnam forces safety requirements – IEC 62133 only, performance requirements – IEC 61960 will be implemented on next phase but no roadmap introduced by MIC Vietnam yet.

- VNTA accepts IEC 62133:2012 (or later version) reports issued by accredited over sea test laboratories. This means CB report is not forced, applicant can still submit IEC 62133 issued by manufacturer if manufacturer’s test laboratory has been accredited for ISO / IEC 17025. ISO / IEC 17025 certificate of test report issuer required to be submitted to VNTA accordingly and the accredited test scope must cover IEC 62133:2012 or later version.

- Since item 2.6-Safety requirements of QCVN 101:2016/BTTTT covers requirements of both battery cell and battery pack, applicant has to submit IEC 62133 for both cell and pack. Applicants (importers, certificate holders) can submit IEC 62133 reports which contains both cell(s) and pack or report(s) of cell(s) and report of pack separately.

- UN38.3 report is not required.

- MSDS of the battery is not required.

- Test items of Lithium Ion Battery and Lithium Ion Polymer Battery accepted to be different.

 

2. Implementation of Lithium Battery Certification in the South of Vietnam – The Verification and Certification Center 2 of VNTA:

Applicants can obtain SDoC certificates for the batteries and the end-products separately. This means applicants can obtain SDoC for their end-products without the battery compliance and there will be no QCVN 101:2016/BTTTT listed on the SDoC certificate of the end-products. The battery will be certified by another single SDoC certificate for the battery only.

The insight of The Verification and Certification Center 2 of VNTA is more related to “post-inspection” and it will helps importers to obtain certificates faster, more convenience. However, the more responsibility for market inspection will be delegated to the Market Surveillance Authority.

Below are the outstanding points for South located applicants:

Applicant can submits applications for SDoC of the battery before application for SDoC of the end product or submit both at the same times so they can obtain both faster.

DoC for the battery is separate so when end-product use a new battery, applicant has to obtain SDoC certificate for the new battery only.

When battery manufacturer use a new cell source(s) or update PWB or make changes in specification of the battery, certificate holder has to renew the SDoC for the battery only. It does not impact certificates of end-products.

Since price to obtain local reports and samples requirements for batteries testing is high in comparisons to local Radio and EMC testing, small importers may skip obtaining certificates for the batteries though they could be fined by Market Surveillance or Auditors of VNTA later. This also means there might be more low quality batteries on the market if the Market Surveillance cannot cover the market audit well.

 

3. Implementation of Lithium Battery Certification in the North of Vietnam – The Verification and Certification Center 1 of VNTA:

Applicants can obtain SDoC certificates for the batteries and the end-products separately. But SDoC for their end-products must contain battery compliance also and there must be QCVN 101:2016/BTTTT listed on the SDoC certificate of the end-products. The battery models name will be suffixed to the models name on SDoC certificate of end-product as well.

The insight of The Verification and Certification Center 1 of VNTA is more related to “pre-inspection” and it will helps to ensure no or less low quality lithium batteries on the market but importers will need more time and cost to obtain necessary certificates for the same product to enter market.

Below are the outstanding points for the north located applicants:

Applicant has submits applications for SDoC of the end-products together with IEC 62133 reports, technical specs, and other required documents of the batteries. This will make the verification process slower.

By the regulations of MIC Vietnam at QCVN 101:2016/BTTTT and Circular 42:2016/TT-BTTTT of MIC Vietnam:

- Lithium Battery is an individual object

- Lithium Battery has its own national technical regulations (QCVN 101:2016/BTTTT)

- Lithium Battery is listed separately on Appendix 2 of the Circular 42:2016/TT-BTTTT of MIC Vietnam and forced to obtain SDoC certificate for itself.

Applicant still have to obtain the SDoC for the Lithium Battery itself and cause applicant has to submit the same set of application documents for the battery twice: For the SDoC of end-product and for the SDoC of the batteries itself.

Battery model name is suffixed to the model name of end-product whenever manufacturer use a new battery, certificate holder has to obtain both new SDoC certificate for the new battery and renew the SDoC of the end-product.

When battery manufacturer use a new cell source or update PWB or make changes in specification of the battery, applicant has to renew both the SDoC for the battery and applied end-products.

 

4. Important notes:

SDoC certificate has long and unidentified validity but this does not mean it has permanent validity forever.

Pursuant to regulation of MIC Vietnam at Circular 30/2011/TT-BTTTT, certificate holder has to renew the SDoC certificate when specification is changed or new regulation is applied to the certified products.
