Draft Circular amendment and supplement to Circular 30/2011/TT-BTTTT – Regulation on MIC Type Approval and Declaration of Conformity certification

EXTENDMAX - Following to Draft Circular to replace existing Circular 42/2016/TT-BTTTT, Ministry of Information and Communications Vietnam (MIC Vietnam) introduces Draft Circular to make amendment and supplement to existing Circular 30/2011/TT-BTTTT - Regulation on MIC Type Approval and Declaration of Conformity certification. Together with Draft Circular replacing Circular 42/2016/TT-BTTTT, this draft circular will cause major impact in procedures to obtain MIC certificate for radio products and ITE, helping the customs clearance process much simpler and faster.

MIC Vietnam has not introduced the implementation date of this Circular yet but it is supposed to enter in effect since 01-July-2018 or later.

 

Pursuant to the new draft Circular replacing Circular 30/2011/TT-BTTTT:

- SDoC certificate will have same validity with according Type Approval certificate for product which subjected to both TA and SDoC (Appendix 1 of Circular 42/2016)

- SDoC certificate will have 3 years validity for products which subjected to SDoC only (Appendix 2 of Circular 42/2016) (Lithium battery, ITE like wired switches, wired router, wired gateway…)

- MIC shortens the standard verification period for application dossier

- SDoC certificate will replace import permit for customs clearance.

- Several minor changes in procedures, certificate forms, and application forms.

- Imported Product Quality Registration form verified and certified by VNTA will be used for customs clearance. VNTA will certified Imported Product Quality Registration form based on a valid SDoC certificate or Importer has to submit SDoC certification dossier later after customs clearance to VNTA.

- MIC could accepts reports issued by oversea accredited test lab for SDoC certification (for products listed on both Appendix 1 and Appendix 2 of Circular 42/2016) (need to be verified by implementation in practice later because there is not enough definition within the regulations to confirm this point at 100% percent)

 

Cross effects

- Since Circular 30/2011/TT-BTTTT is the root regulations of MIC regarding Type Approval and SDoC, any changes of Circular 30/2011/TT-BTTTT will also affect implementation of other regulations issued by MIC Vietnam regarding Type Approval and SDoC certification.

- Together with the new draft circular replacing Circular 42/2016/TT-BTTTT, this circular will lead to the understandings that all SDoC certificate issued before this Circular enter in effect will be invalid and need to be renewed. Because:

   + Draft circular replacing Circular 42/2016/TT-BTTTT only confirms the Type approval certificates issued before 01-July-2018 will keeps its validity till expiry date (MIC does not confirm validity of SDoC certificate issued before 01-July-2018)

   + Existing SDoC certificate (in accordance with Circular 30/2011/TT-BTTTT) does not have an identified validity period, the draft circular introduce a new form of SDoC cert which now has a line for validity period.
